It's basically the same issue as determining if a business should issue a recall or not when people can be injured or killed. They place a certain cost on the damage, in this case the cost of the lawsuit and settlement fees if they lose to 5% of the people who catch on each year vs the profits they make over the course of the year by cutting corners on salary.
"Mistakes happen, it's not our fault you don't audit your pay and bring it to our attention."
If a company openly denies the employee compensation details upon request of the employee, it's no doubt that this is neglect by choice of the management. I just got hired by Swift, and I'll be keeping very close eyes on them, and auditing them carefully. Even when my truck switches over to paperless, I'll still be logging all my trips on paper logs and keep records of everything.

So almost 2 years have passed, any news on the class action case against Swift?
I am being a small bit sarcastic but curious all the same. The only winners are the lawyers that stir up the sh1t and find a few willing drivers that think they will get big bucks from Swift.
