In that scenario you will be allowed to do off-duty driving for up to 1 hour to get to a rest area safe haven. You cannot use this to advance a load or go to your next load. Basically you cannot have a load or a preplan and your DM would have had to know about this issue before it arises

Thanks. I got to consignee with two hours left. I opened doors and load was in floor--not pallets..Crap. I called night DM and advised, She said all I could do is note on my log and if I had to leave the consignee it would be a violation. So, I was wondering if log department at henderson would be the same. Paper logs it wouldn't even be an issue. Some companies say you have a right to go to a safe haven wheras others will use this to threaten your career. Do you run in to situations like this at Henderson?

The elog program Henderson uses lets you have up to an hour for off duty driving. Which may be used during your restart for example to go hit walmart. Or when you are empty and out of hours to go to a safe place to park.
I have never had any problems with it, there is a column you can make a remark in, explaining your actions. -
Thanks, Sabine. That is pretty much what recruiter told me, but I wanted to find out from drivers themselves. How many miles are you averaging? Do they treat you ok? I just need to make a good move and exploring possibilities. You seem happy there.

miles come and go. Some weeks good 3000 miles, some not so good with 2000 miles. The week you go home tends to be bad, since they try to keep you close enough to get you home on time.
I can't complain about how I am being treated. For the most part I get home on time, sometimes a day or two late, sometimes a day early. Truck gets fixed when I say it's broke. Same with the APU.
I got really sick in March, it took 3 weeks before I was able to go back to work. Not a peep out of them. I had a severe respiratory infection that left me feeling like a truck had run over me, I spent 2 weeks just sleeping I think. My truck wasn't taken from me which to me was a big thing. -
Oh, and considering where you live, we seem to have a lot of freight going down to Georgia lately, to McDonough and the Atlanta area too.

Not to be the BAD NEWS BEAR ... But you can't drive off duty just because your empty , you have to be UNLADIEN and by DOT RULES if you are pulling a trailer loaded or empty you are LADIEN
Off duty driving can only be used
1. When UNLADIEN .. See above
2. When not under dispatch , if you are under a dispatch under DOT rules in some cases you are LADIEN
3. When going to a meal break if UNLADIEN
It is not a safe haven extender , if you ever get pulled over you will see what I'm saying is true , and gosh please don't think the DOT won't look at these EOBR logs now cause with so many carriers doing it now they do look -
In that situation they are correct , however you have to log it on the proper line and place the comment as to why you are in violation ( which is going to safe haven ) but you cannot use OFF DUTY DRIVING to do that unless you leave without a trailer ... Or it's still a violation if you are
1. Pulled over
2. Accident

Thanks KY. I had called DOT and talked with them about this. So, I understand strictest interpretation. I spoke to lease op at my company and he says that if they are close to being over, that he was told they could log it as personal time and logs would overlook it. So, basically, they are telling him he can drive 4 more hours and it will be overlooked, wheras if I drive 4 miles to t/s they will tell me I'm in violation. I didn't want to add all this, but, if you are at a consignee (over 14 or right at it) and they tell you that you have to leave...it's not an attempt to drive 4 more hours down the road...

Your correct ... But it's still a violation ..
No where can you find a SAFE HAVEN RULE it's not there as to what I mean is there is no specific guideline for it .. Therefore you are at the mercy of the officer ... If you had a accident during that time try explaining that to a officer ... I was finding a SAFE HAVEN
Not gonna help you a bit ... If your in violation your in violation plain and simple ... No grey area
You simply cannot use Personal Conveyance if you are LAIDEN ( trailer ) plain and simple ...
Pull in a scale and ask them face to face
