According to police, the driver who hit him went around a barrier and into the crash scene. That's when the officer was hit.
The driver of that car was identified as 26-year-old Johoan Rodriguez. He was taken into custody at the scene, then treated for injuries at Ben Taub General Hospital.
Rodriguez was charged Sunday night with intoxication manslaughter of a peace office, felony evading in a motor vehicle and possession of a controlled substance.
His immigration status is also being checked by Immigration and Customs Enforcement.

The officer gunned down # stop light was a sgt with the bexar county sheriffs dept in San antonio tx. He was gunned down at point blank range.

Rodriguez is charged with intoxication manslaughter of a peace officer, felony evading and possession of a controlled substance. Police say his blood alcohol level was nearly three times the legal limit at the time of the crash. They say he also had cocaine in his possession.
We learned from court documents this morning that Rodriguez is not in the country legally. He's due in court later this week. -
so what does that mean? will he just be deported or charged and held here in the states?

Hopefully he is burned at the stake being Memorial Day. Seriously though another example using poor judgement, somebody else having to suffer life and career ending injury and the offender spending sometime behind bars instead of meeting the ultimate punishment. All because of alcohol. My prayers go out to the officer and his family.

He's being held in Harris county jail without bond on immigration hold. Yes he's facing several felony charges for killing this officer.

And this is why people continue to drive drunk. Kill someone, oh no biggie, you weren't in control so here's your slap on the wrist. But if it's an officer then it actually becomes something to be put in jail over. Of course the laws conveniently ignore the option of putting all drunk drivers behind bars on the first offense so the number f drunk deaths would actually go down.

its lose-lose if you deport him he gets off free and jumps the fence again in a month, you hold him in jail we the tax payers pay for his free room and meal ticket. i think america should bring back the guillotine and speed up death row. if you dont agree with my opinion i'm sorry(not for my opinion but for yours)

HOUSTON (KTRK) -- We have new information about a man accused of hitting and killing a Houston police officer over the weekend.
Not only is the suspect an undocumented immigrant, but federal authorities say he's been deported twice.
Police say Johoan Rodriguez crashed his car through a police barricade at the North Loop and Yale on Sunday morning, killing HPD Officer Kevin Will. Immigrations and Customs Enforcement officials say Rodriguez is from Mexico and had been deported in December of 2005 and January of 2006.
Rodriguez remains in a Harris County jail, charged with intoxication manslaughter of a peace officer, felony evading arrest, and possession of a controlled substance. He has now been placed on an immigration detainer.Last edited: May 31, 2011
