Its always good to have a paper log along with the e-logs, just so you have peace of mind! Thats just my opinion!!

Off-duty driving rules specifically discuss being unladen. However, I can't count the number of times I've moved from the truckstop to a walmart, or parked near a nice restaurant, or within walking distance from a karaoke place... not like any bears are going to be checking your status as you drive between a truckstop and a Walmart...
This is more about whether you count the time against your 11/14/70 or not, not where you go or what you do. Between all of that listed above, you'd better bet I'd log it as off-duty time.semijoesd Thanks this. -
We have the OFF DUTY - DRIVING option in the Qualcomm EOBR we are using. The carrier at first wanted to "limit" how it could be used by O/O (something like less than 5 miles and then only occasionally). After explaining that I would call my son, who is an agent at the IRS, that the personal use of MY tractor was being limited by the carrier, they then changed this policy. No need to have the IRS look at the O/O as regular employees.
So, that being said, I use the OFF DUTY - DRIVING once in a while and the most I racked up on it at one time was roughly 85 miles. Of course, all bobtail. No conflict with regs. No conflict with carrier. No conflict with the EOBR.
Oh, that is why you also pay for unladen liability insurance (bobtail). Just like operating your personal auto. And you can get sued driving that as well. -
whether "line 5" is considered ok bythe dot or not.
just the fact that they would know you had alrdy ran out your 11,or worse your 14 hr clock could be used against you in a lawsuit,whether civil or criminal.. it could also be used to say you were fatigued etc etc..
i would do it for certain things,im just sayin it could end up being a big problem if something happens. -
They could also use the fact that you had a turkey sandwich for lunch against you. After all, everybody knows turkey causes your fat uncle Greg to sleep on the couch after Thanksgiving supper. So, a good driver will make sure he never has turkey within eight hours of driving. In fact, a really conscientious driver will make sure he doesn't even so much as look at a turkey any time he's on the road. Surely, that will save him from lawsuits.

Still, I'm finding this lawsuit paranoia strange, odd, and funny - I think people have been listening to the self-appointed "guess what I heard" guy at the truckstop for way too long.
Grow up, quit listening to the garbage, and quit letting your imagination get the best of you. If insane lawsuits, at least the basis for them, were for real, we'd easily have the ability to post the case law link. I have a subscription to findlaw.com - a case law listing, in fact, THE case law listing in the nation, and I've looked up cases like we're talking about. They simply don't exist.Tazz Thanks this. -

I guess each company has its own policy about use of their line 5. I know my company makes it so difficult for a driver to use line 5 that I don't even bother trying.
- Driver has to send macro requesting use of line 5 and wait for dispatcher's approval.
- Can't be out of hrs.
- Can't be under a load
- Can't have a trailer
- Can't wait more than 2 hrs after dsp approval to use line 5.

Company told us to log off duty as long as we had hours, and not over 100 miles for restaurants, the -Marts,or if a customer said to leave their property. Company had one accident and insurance paid off because o/o was going for trk repairs, however I haven,t heard about the civil lawsuit part of this.
