    Not to mention how they will seriously affect their DAC report which in turn will affect their ability to make money in this industry. The information reported is like the credit bureaus do, 7 yrs. How do I know, personal experience and I have something on my DAC reported from Swift that falls off the 18th of this month, the report date 6-18-04. Your friends would've done better to get fired than to default on a loan in a recession based timeframe. That makes them stupid and you know how the saying goes....guilty by association:biggrin_25523:

    I grew up with these people and they are very good friends. We never been in back of a cop car yet. This is aggravating.

    unless it's a federally guaranteed student loan,

    they can't garnish wages in texas, was my point.

    And they can't seize property, or lien property....but the debt does exist everywhere else and the credit report will follow!

    If they signed a contract upon entering and agreeing to go to their school stating that they would be obligated to a certain length of term of employment once completing the school or repay the school if they quit early (or something to that effect), that are on the hook. Worst case the school can sue, if they win and get a judgment, they can then legally sieze and assets includeing bank accounts and real property (ie: homes). Realistically, it would just go to collections and screw their credit and get endless harassment.

    If no such agreement was in writing when they signed up (which I seriously doubt that it wasnt in the fine print somewhere...especially for Swift), they would be free to walk away at any time.

    i dont know about the headline for this post....its niether funny nor interesting.....just shows that irresponsible people are spoiling our image any chance they get .

    How do you folks think huge Mega- size trucking companies became so big? They don't miss the chance to make a penny. I'm a Texan, too- they can't really take a house but they can certainly put a mechanic's lien against it. Meanwhile, they get the dirtiest, most foul-mannered bill collectors in the business to get every nickel, dime and penny (with a hefty legal services bill attached) from your friends. They will threaten, intimidate, humiliate and harass them until your friends can't stand any more and start making payments. They do it for a percentage of what they collect. They can stop it but will need a lawyer to deal with the bill collectors.
    Word to the wise: debts like this are a form of indentured servitude. If you don't want to work like a trucker, don't make agreements with trucking schools or trucking companies. Work at McDonald's. The pay and bennies are better.

    How can they go after someones "friends" for a debt they have nothing to do with? That doesn't even make sense.

    Now as far as the poster who said they are guilty of theft. . .

    I don't think so, at least legally. Unless it can be proven that they started out with the intent to defraud the school, it is pretty much going to be a civil matter.

    I do believe there is one hell of a difference in going through the school and getting your CDL and then leaving, than there is in going through the school, getting your CDL, working for the company for a while, and THEN leaving for whatever reason.

    But I don't see any type of criminal activity here. Just a whole lot of loose morals on the part of the guys who pulled this, and on the part of their cheer leader. . .

    But then, mine is not to judge. . .

    OH BULL SCHIDT! IT IS TOO.

    If they started out with the intent to pull this crap, no matter WHAT the law says, they are thieves. They just won't be criminally prosecuted for it.

    But they will find it will haunt them for a hell of a lot of years.
