Arnold/US Xpress truck stolen=driver terminated

    I believe I'd fight that one, if I wanted my job at USX back. Or if not, I'd fight the wrongful termination. I don't see how someone stealing your locked truck is your responsibility. Had they stolen it from your yard, while you were away, would that be your responsibility?

    If you had permission to park there while on home time, and you secured the truck, you are not responsible. I think you have a good wrongful termination case.

    it all comes down to procedure, did you follow the vehicle securement procedure when you were at home with the load. If not you've got some skin in this. If you did you should be fighting this.

    Well if they gave you written permission to park there and you followed standard procedure, then you have a case in my opinion.

    my guess is procedure is more than taking the keys home and putting a lock on the trailer.

    My question is ... how do you fight the wrongful termination? I call safety and they pass me off to another office which goes to voicemail. They don't return my calls. I asked what procedures I didn't follow and where are they written. The 26 year safety guy I spoke to that is no longer with them said that those procedures are not written anywhere but is comunicated through the DM. He said I should fight it too. My question is.... HOW? And no, I do not want to work for these guys again but I'd like to clear my name.

    So when you got the axe I'm sure they took your drivers reference guide, or orientation binder right? If they didn't go through it and find something that states what the actual procedure is. If they took it call some of your friends from the company and see if they'll help you out. If you are on good terms with someone in dispatch contact them to see what the procedures for parking at home under dispatch are and where they can be found. Then contact a lawyer or like your department of workforce development to get started.


    Oh and don't take what I'm saying as instruction or fact, I'm just making it up as I go.

    Hire a employment lawyer, if nothing else he probly can get them to remove the termination from your record.

    Just move on to the next company !!!
