Besides you guys don't even know your amendments...4th amendment is for the right to equal justice....Injun was not arrested only detained...which is legal to investigate a report of any crime. Especially regarding unreasonable search and seizure....this is a commercial vehicle, used for transporting goods across state lines. We all understand that we fall under a different set of rules in regard to searching our vehicles....as they do not completely qualify as property of domicile, although we tend to live in the truck more than a physical residence established on Terra Firma of USA!
Now drop it and take it over to Politics! END OF DISCUSSION! -
And P.S. who are you to say end of discussion to us? You seem like a very intelligent person and obviously you have a great understanding of the las and the constitution. But this isnt a attempted hijacking and is very relevant to the OP. -

Far too many cases, starting out to be legitimate complaints of "police mishandling" have become blown out of proportion by the "Constitutional Violationists" and taking the legitimate case away from the problem at hand.
Every Police Department, or Law Enforcement Agency, knows and understands they have in their midst a few officers that have, or come to have, an "authority complex"....the only way to show who these officers are is to file complaints pursuant to the precise issue as it happened. Not to exaggerate the incident into a conspiracy of "police take over".
So leave the "political Constitutional rhetoric" of amendments and their meaning to politics and deal with each situation as it is....not blown out of proportion with grandiose images of citizen anarchy and rioting in the streets. -
yea.... i do too/ sorry but I just aint buying this story for one bit. I believe it happened but not the way driver says it.
First off:
Dispatch needs to know were the units are at all times. FACT.
Second:
Police will not confront someone with out RUNNING the plate and knowing who they are dealing with before they act. They would have ran the plate to the truck and trailer before even stopping infront or behind it.
Third:
When LEOs confront someone who is behind a closed door and doesn't announce who he is then a major police/safety procedure has been violated.
Forth:
Why not lay on the air horn and start yelling and making as much noise as possible if your are really that scared for your life and in a truck stop with your fellow comrades??? Just sayin....
Fifth :
WHEN they do confront a person in a situation like she describes the dispatch will go HOT (meaning all none emergency will hold). There is a time period of about a 2 minute gap. The time he leaves his car and commits to confront the suspect until he gets control of the situation. As it is hot the nearby agency's will be aware of this and waiting to see what transpires (person draws on them, runs on foot, fist a cuffs, lays there and complies etc).
Now with all that said: I am not calling her a liar. I'm just saying this might not be EXACTLY how it went down. She might take things differently because of adrenaline , fear of past truck stop experiences, etc.
There are logs of the incident in the dispatch logs for the agency. I would like to see those before I make a judgment.
BUt I do know cops go thru A TON of training on how to make it home alive at the end of the shift and a lot of this seems to me like he was doing his job.
Here is how I could see this.
Dispatcher gets call somethings up at this truck (specfic info incall).
Dispatch sends unit out.
Dispatch sends cover car.
Both meet up somewhere in parking lot to form a plan to confront the said truck and driver.
They run the plates for Intel gathering.
Decide to confront with the info they have they feel they can handle it with no one else needed.
Dispatch goes emergency only (aka hot).
Bangs on door.
Dog barking.
Driver doesn't comply.
dog freaking out.
Driver cracks door then tries to dive back in.
dog still freaking out.
He doesn't know if she has a gun/knife/co driver with a weapon hostage or what inside.
dog still freaking out in the back ground.
Officer gets control by garbing driver and yanking out of truck.
dog still freaking out. (you get the point. Its loud)
Puts driver in cuffs for his safety.
Dispatch goes cold.
All is good.
He investigates (asks questions etc).
Searches truck.
Finds nothing.
No laws broken.
Driver is free to go.
Point is this could have been avoided. BY either calling 911 asap when she heard the banging and hid in the sleeper.
Liad on the air horn if she was really that scared.
NOT try to turn and go back in the sleeper after he said who he was and told her to get out.
This could of went down a million and one ways.
Im just saying this is how this particular driver saw/says it happened.
I would like to hear the cops treatments/statements regarding this to make a serious opinion.
WERE exactly did this happen?
WHat time?
What was the cops name?
Either way maybe you should get a lawyer to look in to this IF this is exactly what happened. There is legal counsel out there that will help you free of charge. Call your states BAR and explain your side. They will then refer you 3 random lawyers who deal with this kind of cases. Then you call them and go sign a statement with your version and sit back. They will do the rest. If some ones rights were trampled. Then someone will be liable. If not then you have a large bill and egg on your face.
Also your company you said was swift? They have more lawyers then you can count. If they felt on of their drivers was assaulted by LEOs expect there to be a full investigation. IF YOU TELL them and make a written complaint to the HR dept. IF you don't then they don't know so can't act on your behalf. -
