Need a second chance, please help

    I am glad that smoking pot is not a regular thing with you. I understand the difficulty you must have gone through with your loss. Since the company that you took the failed test with doesn't report to DAC, then you have a good opportunity to get back in the business without a long wait. If you were not fired from your previous driving job and they have reported it as such, then I would contest it and also get in touch with your previous carrier and see what may have happened and if they will correct your file. Since you have been away from driving for a year and a half, you may need to go with a trainer for a couple of weeks so that they can feel confident that you know what you are doing. I think that you can find a carrier who will hire you. There are a lot of carriers and there is expected to be a driver shortage by the end of this year. When there is a shortage, carriers are more willing to over come short comings.

    sorry for your loss. was it 3 months since you smoked when you took your test or now it has been 3 months? 3 months might not be long enough if you get a second chance ,just a heads up.

    Sorry for your terrible loss. I can not imagine what I would do if that happened to me. You don't need any advice on what you should have done. I'm sure you knew what you were doing and the risk you took. What you need now is knowing what to do to move forward.

    If the drug test does not show up then that's one problem you don't have to face. If the time bewteen jobs is a problem then you may have to go to a refresher course. You should dispute the Swift firing and you can see others have given good links to take care of that.

    If the drug test does become a problem then you'll need to follow the requirements listed in the FMCSA's subpart O "Return-To-Duty" process to show you will no longer be a liability. I know that is alot of work and expense but it should clear your record. Or you may want to find a smaller company that does not use the DAC system and goes by experience and work ethics. You never know you might be better off that way anyway. Whatever you do there is no need to explain why you did what you did except to the people that matter. The less your co-workers know the better off you'll be. Good luck and again I'm sorry for your loss.

    My condolences. In my old business I have often dealt with grieving families and it is never easy. I tell them to remember the good times, keep that in your heart, and she will always be with you.

    I seriously question your positive drug test and how it was done/not reported to dac. First off the length of time THC stays in your system is directly proportionate to the amount of body fat you have (it's stored in fat cells) and how much you used (smokes, ingested, whatever). Based on the info you gave, if it is indeed accurate, there is no way a whiz quiz should have popped positive for you. Lets say I know this guy who was a very heavy smoker for 15 years, he's 6' 250lbs, he quits for 1 month and passes 3 different whiz tests. I think you popped a false positive. Did the company take 2 samples? Were they sealed and signed by you? Did they do a second lab test to confirm the findings? All these questions come to mind given your side of the story.

    In any case I hope it works out for you. The pain will never totally go away, but it can be dulled with good feeling and memories better than any drug or drink could ever do.

    I sorry for your loss, but turning to any illegal drug, should never be a concideration, I wish you well and luck in finding a job
