Despite lost and found's constant (and baffling) need to belittle me, i would have to agree with him/her; Off duty means off duty---there is no requirement to even sleep. i've never been asked for a reciept when i was with auto truck or other companies---we had lots of daycabs yet did otr. There is no legal requirement for hotel reciepts etc. Although it might be a good idea to get one whenever possible.

    b) i was going to do the tent thing as well. One thing many people may not realize is that with all the fresh air and circulation, this could actually be some of the best sleep you can get.

Now, i'd like to expand on the topic and ask a question as well:
We know that anytime you are in the driver's OR passenger's seat in a daycab this is on duty. If there are any exceptions to the rule let me know, because i don't believe there are any exceptions to this rule. Now, let's say you have a sleeper cab. In the middle of the night you want to either turn the engine off(more likely) or turn it on. Would this action constitute going on duty and thus now you have to start the 10 hours process all over again?

What if you get out of the truck to go inside the truckstop to use the restrooms etc? Is the cab area (driver's and passenger's seat and space in between them considered on duty anytime you are in that plane/break the plane? Would this action be considered going on duty?

What if you're sitting up front, but with the curtains closed?

If you close the curtains does that make the entire cab part of the sleeper?

This splitting hairs over WHERE you are in the truck is stupid, insane, and useless. No one knows where you are in the truck but YOU, and since it really doesn't matter, why even discuss it, or form it as a basis for some non-existent standard?

NO ONE is watching you, so please dismiss all that useless "what if" stuff as the pure nonsense that it is.

I thought the "Mall Parking Lot" was over the top, and now this post? Methinks some are so anal he needn't worry about the "Bear" in the pickle park, I'd bet one couldn't drive a toothpick up 'there' with a sledgehammer!

Just to clarify, not your post Ronin...

I argued with an old friend who was driving for CRE. He drove during the day, his wife drove at night, and they were on e-logs. He was ALWAYS 25-30 hours off from her hours.... that many hours LESS, not more.

His reasoning was that he did some of the pickups and deliveries and drops and hooks. He would go to line 4 as soon as he pulled into a drop and hook location and leave it there (not editing it later) and log that whole time... sometimes over an hour to drop where they need it, get your paperwork, find yoru trailer, etc... I mean WHO really logs more than 15 for a D&H? Many only flag it.

This guy was killing 20-25-30 hours a week by logging line 4 for everything from wandering around a drop yard, to sitting IN THE DRIVER'S SEAT, playing on the laptop at a truckstop... he logged it that way because he was in the driver's seat and not the sleeper.

I think many people read way too much into all of this stuff... and make it a lot harder for themselves than they have to.

i am trying to get everything right and proper----what if, let's say, you did have to go outside for whatever reason----and thus broke the plane (let's say for now anywhere in the cab area IS on duty).

Later in the day you get into an accident whether your fault or not. Let's say it wasn't your fault. BUT because you broke the plane and went on duty now it is your fault and the accident was serious etc. etc. etc.....

Let's just answer the questions instead of getting on me for being anal.

Why answer a question that is totally pointless and exceeds the bounds of common sense?

    Let's see;
I'm sitting in the drivers seat picking my whatever; line 4
I open the door and step outside; line 1
I walk to the back of the trailer to stretch my legs, and happen to see one of my marker lights cracked; OMG, I better go back to line 4
I walk to the TS building to buy a new light; Oh, stilll on 4
But wait, there's a McD's in there and I'm hungry, dang it; back to the truck to get my logbook so I can go to line 1
Finish eating; go to line 4 so I can legally pay for new marker light,,,,,,,,,,,,,,
And on, and on, and on,,,,,,,,,,,,,,,,,,,,
Does all that sound pretty ridiculous? Guess what, it is, geez guys, we're drivers, not injuneers, let's use the common sense God gave us.

Thanks, johnday, my point exactly. There's no special ops team positioned on top of the truckstop with night vision goggles.. making sure that you log yout restroom breaks in the middle of the night... but hey, you're NOT in the sleeper... are you off duty if you walk inside?
