workers comp north carolina

    Can anybody give me good insight on requirements in this state specifically?

    Right now I pay about $75.00 a week.
    Someone told me that since I have an LLC I could exempt myself and pay less.
    I have asked numerous insurance agents and I get different answers.
    I tried reading the statue itself but I cannot find who is required. Being that I work for myself and I wouldn't file a claim against myself.

    you could probably apply for an exemption, but most shippers and receivers will not allow you on the property with out. They don't care if the state exempts you or not. All depends on whether they check you out or not. some do some don't.

    I have only one shipper that requires Occ. Accident Insurance. Of the few that even ask I can state I am exempt.

    From the rate you are paying you are better off with OA policy. Better coverage and cheaper. NE has allowed for "owners" to elect to be covered. So like many states it is not an issue of making a claim against yourself. It is allowed.

    But have a qualified agent compare OA policy and WC policy. You will likely see better coverage and rates.

    North Carolina is not a WC friendly state and OA is useless in NC. I cant explain it the way my agent explained it to me but he did tell me the cost of WC in NC was over twice what it is in any other state. And NC wont accept OA claims. The way he explained it to me you cant get a OA policy written in NC. He also explained that the difference in WC and OA, OA have a cap and once you hit the cap there is no more payout where WC dont have a cap. He also explain that some NC agents write what is called a "ghost policy" to satisfy shippers that require it. When I was leased to Tango I had OA which he explained was fine but any claims would have to be files through the state that issued the OA which was La. All the O/O I know including myself dont carry WC and far as I know never had a problem with a shipper or Broker.
