How to Refuse a Police Search (USA only)

Where I live now...even on my bike...I was getting pulled over...(no bike light)...cops would pull me over on me bike...and proceed to squeeze my butt...like Charmin TP....



After a while I got use to it, and expected it...like a message or something...

But after coming in contact with me...they would laugh and let me go

After running their hands down my butt...

They would always say...'Mind if we search you for your saftey and ours?'

And I would say 'Ye sure officer'...next thing I know their hands are sliding down my behind...it tickles...I laugh...and they peel off...

Cops just think I'm odd...I don't make sense to them...

 

Ok my ny attorney told me if I might find self close to. .08 like .09 .10 .13 to not refuse the tests but to ONLY say I would like to consult with my attorney before any more questioning. They will take you in by the time your attorney gets to you and advises you that you should take the drunk quiz you should pass but don't refuse if you value your cdl and that is well with in your rights on the dui topic for ny state.

 

Good catch DB. I like it when a member catches another with his pants down, lol. By his signature, you can about figure it out.

I find it even distasteful trying to tell a commercial driver how to beat a DUI. We don't want them on the road. Last I remember a refusal of a breathalizer will cause you to lose your license and will go on your MVR at minimum.

captw900, it's .04 in a CMV. .08 in a POV. Those numbers really aren't impared. It should of stayed .10. Thanks to mad MADD people that have 2-3 beers are being prosecuted.

 

Wow all of these problems being searched ! I have only been asked once and it was at a specific site that was military and they were checking everybody. Now I kept my curtains closed he asked if he could open I said sure and he looked and walked away. no problem took maybe 5 minutes and we were both on our way. it sounds like people cause trouble for themselves. IMO

 

I have had a few civilian police ask to search my truck and I said no, no one hand cuffed me or gave me a wood shampoo. No hours detained at a chicken coop or roadside intervention, but I never gave anyone a bad attitude and always remained respectful with no snarly comments.


But having run many a load in and out of military bases I will say this on my experience, they will search your truck and if you say no they will refuse entry plain and simple. I have given military police and government agents permission to search every time at bases and installations.

Also, refuse a Port inspection and you will be denied entry from my observation of others do such.

Not true...blood can never be forced for a standard DUI. No such thing as a court order for refusing to submit to a chemical test. Its not a crime to refuse a test in any state. at worst you lose your license for 180 days (california its up to a year)..As far as a hospital drawing blood for something in addition to a DUI as a result of a DUI stop, the evidence could not be used for the DUI charge. If you have ever heard of "Fruits of The Poisonous Tree?" then this would apply..evidence taken illegally and, or used for separate charge.

So what you wrote is not necessarily true, not in any state. Unless you come across a corrupt cop who's gonna lie then all you said will be true. But yes! you're right in saying obey the law and they'll have nothing to harass you over.

 

Yes Sir, you are correct about government facilities. You have to submit to searches, as well as custody facilities too. I was referring to civilian cops rolling up on you and wanting to search your vehicle/sleeper berth. To all who read this, I never said be disrespectful to any cop, I hated when people were acting like Richard craniums to me. All I am saying is enforce your rights as a private citizen. It's ok for the TSA to continually violate the 4th to search a wheelchair bound grandmother, but tread lightly when search a female/male Muslim. I guess we do this in the name of freedom and security. Funny thing is, El Al airlines (Israel) don't use the type of search equipment we use and the NEVER have had an incident...ever! They use PROFILING!

By the way, I love the reference to a "wood shampoo", that freakin rules! LOL!

Wasn't telling how a commercial driver should dodge a DUI charge..If you read more clearly you would have noticed I wrote, "This doesn't apply to CDL drivers." We all know the consequences if a driver is stopped for DUI and refuses. That's a no brainer. So, if I wasn't clear enough I apologize to you my friend. Yes, a refusal will go on an MVR, but so will the DUI and it will linger on the MVR just as long as the DUI. Either way it's a no win, one is just a lesser of the two evils. After making over 120 DUI arrests I've seen many out comes. One common denominator was, no evidence, no DUI conviction. Only a plea agreement for a lesser charge or a trial by jury (rare) with an acquittal.

Best defense is, Don't drink and drive! You've heard of DDAMM right? Drunk Drivers Against Mad Mothers... Just kidding! MADD is a fine lobbiest organization and has done good work.

Would the type of profiling you have in mind, have stopped this guy from doing what they did?

Or the guy before him who earlier in the summer mowed down 69 youth campers in the Netherlands?

Do any of these two fall into your 'profile' arena?

Or would you of let them walk right past you, cause they did not 'fit' your idea of what a threat is or looks like??
