New law reading no driving from midnight to 6am

    Read this it is from FMCSA's website on the proposed HOS rules due next month.

    Max. driving within driving window
    10 or 11 hrs. (Both being considered)

    Limit on consecutive hours of driving
    May drive only if it has been 7 hours or less since last off-duty period of at least 30 minutes

    Restart
    (1) Must include two periods between Midnight-6 a.m.;
    (2) May only be used once per week.
    (3) Driver must designate the period being used as a restart


    On-duty time
    Does not include any time resting in a parked CMV. In moving CMV, does not include up to 2 hrs. in passenger seat immediately before or after 8 consecutive hrs. in sleeper-berth. <---- This should have already been in the rule book.

    it was on fox and friends one am. this week he was interviewing someone they talked about this and said it was coming oct. or nov. brian kilmey did interview. i heard it too.

    Lets make thing harder instead of easier. Just go's to show you how out of touch with the real world these idiots in goverment are. The rules the way they are work fine but just because some speacial interest groups opposed them they have to go and make them happy at are expense. So now a driver that could get home in 11 hours will have to spend 10 hours in his truck an hour away from is home and family. Idiots, just plain idiots. Be alot more guys fudging there books including me untill they force eobr down are throught.

    The problem is the FMCSA is trying to settle a lawsuit from Public Citizen and other "safety" advocate groups. Funny thing is, if these regs go through, it will put more trucks on the road, which these people HATE now. Good move window lickers.

    It's too bad the FMCSA lawyer and the judge weren't smarter and had thrown this out of court, we wouldn't be dealing with this BS!

    Just to clarify do not forget that OOIDA, The IBT, and the ATA all filed lawsuits against the new/old or old/new rules depending on your perspective as well. Same as all three of those entities have already clearly stated in numerous releases they already have their lawsuits waiting to be filed the moment the final rule is posted.

    The study started with Syracuse university civil engineering students tasked with relieving NYC congestion if I remember right. Obama and the rest of the federal stooges sent some suits to cont fenders and spend millions to achieve their" success".


    Really kind of common sense a good portion had been practicing since I've been around and probably years before that. But now they actually have some number to put in front of business' advocating the logisticsbshift I guess. DC did a similar study finding( brace yourself ) that off peak deliveries reduced congestion and benefited supply chain speed.

    But I agree the state or in NYC's case they should be paying for it but I think that was just some attachement the feds glommed on kinda like all those recovery signs you see on highway projects. Some of those projects have been going since Nixon left but they all count as" recovery jobs" now. Probably a discussion better held somewhere else though.
