I need some advice folks!
I am trying to find a company (OTR since I am just now in CDL school) who will work with a misdeameanor charge of Leaving The Scene of an Accident. This case was dismissed. I was not convicted. It was in 2009

If it was dismissed, you don't need to mention it. Charged with a crime and convicted of a crime are 2 different things. Charges mean nothing if there were no convictions. The only time you would need to mention it is if the application specifically asks if you were charged with a crime. Leaving the scene of a accident is still a traffic infraction. That shouldn't be on your criminal record. Run a backround check on yourself and check your MVR. If both records are clean, you can keep your mouth shut about the charge.

companies frequently change their requirements, your best bet is to keep applying..although...i have seen lists of what certain companies will and wont accept,but i dont have a link...google it.
if it was dismissed dont even list it..BUT, if it IS on your mvr, theyll see it anyway,so you might as well list it.
it is likely listed on mvr, because the mvr shows -anything- , even if someone runs a stop sign and rear ends you, it can be on your mvr...it doesnt have to be your fault. depends on which state your license is with.
seat belt tickets show also, virginia even reported a operating faulty equipment on my mvr when they did a lvl 1 inspection and all they could find was a small crack in window at the very bottom,outside of field of view.
because of the fact that theyll likely bring it up once they see it on your record state it was dismissed,and have PROOF. alot of companies wont care that you have proof,but some will.Last edited: Nov 2, 2011

If it still shows on your MVR or criminal record then get it expunged. That's why I noted to run backround checks on yourself.
This should have been thought of and taken care of before you start applying for a job driving a CMV. -

Thanks again. It doesn't seem to AS much of a problem as I anticipated. I did think of it before, but timing would not allow me to completly take care of it before hand.

find a small local company..the big companies will not even talk to you. get some time under your belt then you will be able to move on if you r not happy with the small co. The smaller Compaies are not as black and white with thier requirements as the big companies are..If they need u they will find a way to get u hired..Good luck!!

Employers are only supposed to go by what you are convicted of, not what you were initially charged with or arrested for. Unfortunately, criminal records are public records and since most Clerk of Courts websites are now searchable online databases, people can now view detailed court dockets and details of cases, such as what you were originally charged with or plea-bargained down. These court dockets dont go away unless they are officially legally expunged from public view. In the end, it all depends on the person who is making the judgement call.
