    Isn't that what I said? "If a Mississippi learners permit holder were to drive (With a licensed driver) to any other state, he would need a Medical Certificate."

    An FYI too: I got yanked into a random roadside recently and the first thing he asked for was the medical ( after he yanked open the door ) .....as I was digging in the billfold he snarled... " That's an automatic ticket if you don't have one!" and of course being who I am I said "easy boy, I got it right here " .......

    And it ended well after a rough start, I have a pretty #1 in the right corner of my windshield.

    They don't get to just yank my door open. For one thing, it's locked. It locks automatically when my speed exceeds 15mph. For another thing, that is an aggressive approach to which I may be inclined to react to...by bailing out the passenger door and running away from him. If I think first. If I don't, I'm likely to mouth off and grab my door to shut it.

    No need to be aggressive like that

    My bad, I misread. In answer to his statement though there currently is no provision in MS that requires a permit holder to obtain a medical certificate to be able to drive intrastate. There soon will be though.

    This is an area where you want to be very careful. Again I don't know Mississippi law so I defer to your knowledge of the laws there. My point though is to make sure there is no regulation in Mississippi law that refers you back to Federal law. Most of the states have laws that in absence of a state exception make all the Federal laws state laws as well. Just because the state of Mississippi does not actually spell out a requirement for a medical card does not mean that there is not another regulation that makes the Federal Law as written in the federal book the law in regard to medical cards. Also while I am not an Attorney, who in their right mind would drive a CMV intrastate in Mississippi without a card and take a chance with losing a million dollar + lawsuit in case of a serious accident.

    I believe someone (CondoCruiser) a page or two back pointed out that currently the fed regs do not require it for intrastate CLP's, but soon will. (383.71).


    Maybe we need a thread concerning people in their right minds and what they would do as compared to people in their wrong minds.:yes2557: There are numerous drivers out there with medical certificates that either they, their wives or friends filled out and signed and none give a rat's behind about a lawsuit. That's one thing the feds and states are attempting to fix.

    very intresting discussion...thanks to all. Here is what happen, I went to take my CDL permit test. Before testing they checked my eyes, asked me a medical questionare and ended with "are you medically fit to drive a big truck"....Well yes I am! Thats all i got. I passed and got permit. I know when I get full CDL I'll need to present to DMV I have one. to solve issue I'm just getting one. AND IF YOU THINK THE OK DMV WEBSITE SUCKS, TRY CALLING THESE PEOPLE!!!:biggrin_25510:

    Don't kid yourself. If you're in a state that doesn't require you to have a medical card in order to get a CDL permit/license, that doesn't mean you don't need one to drive. ANYONE driving a CMV, ANYWHERE, needs a current medical card in their possession. Period.

    This is kind of my thinking as well. The problem I have with all of this is how do you show an officer you are strictly intrastate? This is even if driving intrastate in Mississippi without a medical is legal. Because from where I stand if your truck is licensed and permitted for multiple states even if you don't cross a state line, you best have a medical card or you are seriously risking a serious OOS order and a large fine!
