Well to answer your question your insurance is going to be a flat rate, to the best of my knowledge, you can't move it off and on like car insurance...just my $.02 if you can make 2g's on the weekend why not leave the company job and do it full time? It seems you would gross more than enough to off-set whatever insurance and retirement benifits you could be getting as a company driver, if its not available right definatley put your foot in the door because unless my math is wrong working 8 hrs a day for 7 days and making 7 grand using very little fuel sounds really nice

Yeah the problem I see you running into is hours. If you are running otr during the week it doesn't matter if you are driving 8 mile runs or flipping burgers on the weekend, if you work for compensation you have to log it on duty ie. Say I drive 5 days a week and use 50 hours, then on the weekend I moonlight at a computer shop for 5 hours a day saturday and sunday, come monday I will have 10 hours to run and could have 2 days until I get rollover hours. If your otr is a dedicated run where you know exactly how many hours you use each week you could probably swing it, but time management would be key. Get stuck in traffic or behind an accident a few times and your plan will be shot to heck.

You have to be careful saying freight isn't interstate and not under FMCSR . Freight delivered to a distribution center that came from another state then transferred within the state could be considered an interstate shipment . Freight moved through LTL terminals would be an example .

Just because it is local does not mean there are not limitations on hours you are allowed to run. You need to check with your safety department and get the OK from them PERIOD.

B-1. Do these HOS regulations apply to intrastate commerce?

No. Intrastate commercial motor vehicle regulations are under the jurisdiction of each State. The HOS regulations apply directly only to interstate commerce. However, most States have adopted intrastate regulations which are identical or very similar to the Federal hours-of-service regulations. A driver involved exclusively in intrastate operations should contact the State agency handling commercial vehicle enforcement in the driver's home State with any questions. Usually this is the state police or highway patrol, although in some States, the function is handled by the department of motor vehicles, department of public safety, or public service commission.

What we haul is frac-sand made at the plant and transloaded too the same company differant location "same state" loaded onto rail cars then shipped out of state. So I think seeing that we haul it before it leaves the state that it does not apply too us.

Illinois -Illinois has adopted the federal hours of service regulations. However, the 100 air-mile record of duty status (logbook) exemption has been upped to 150 miles for intrastate drivers. For more information, please contact the Illinois Department of Transportation at (217) 785-1181.

Tax wise you will do great because being in business opens up a ton of deductions you can claim. Considering the huge percentage that employers pull from an employee's check you will probably get a lot of that back as a refund.
