15 min left on the 11 and 14 hr clock

    i was talking about this on the radio the other night. some other driver mentioned something i have never heard. he claims that if the DOT or what ever holds you up with an inspection, you can go to a safe haven.

    i for one find that to be a load of crap. a scalemaster has no problem parking anyone if they are in violation on paper. that is like saying he would let someone go for being way over and telling them to go park at the next rest area. i tried to debate that with him (driver on the radio), but he didnt want to hear anything to the contrary.

    Now i get it. thanks yall.

    As far as 15 minutes bumping the dock or something. I usually log about 5 miniutes for customer check in and then the rest as sleeper since im usually in the sleeper anyway. I couldnt imagine how many hours would be wasted if I were to have to be outside my truck or something at a shipper/receiver on duty ya know.

    Why bother arguing ? If he wants to drive to a safe haven if he's put OOS let him go for it.

    If you are stopped on the side of the road, they will usually let you proceed to a safe haven. They do not want you sitting on the shoulder of the road (possibly blocking part of the travel lane) where they stopped you until your log book catches up to you or repairs are made. In that case, they will usually direct you where to go...parking lot, hotel, truck stop, etc...and you are to proceed to that place (or try to negotiate an alternate place if you know of one in the area). If the officer tells you to go somewhere, and you go somewhere else, you could be in trouble.

    If you are pulled around back behind a scale house and given an inspection, you ARE ALREADY AT a safe haven...so you will not be allowed to leave.

    You tell him that you are going to park at the next safe parking that wont hinder the regular movement of traffic. You then ask for his badge number and what office he is out of. Ask him to initial the exact time he pulled you over on your log book, and the reason he pulled you over. When he asks why tell him you dont feel he had just cause for pulling you over. They can only ask for you to disclose your log book if they have just cause, you have the right to not surrender your log book if you feel you may incriminate yourself.

    Actually no he can't he needs to be able to show just cause. Any 5 cent lawyer would tear him apart in court without just cause being shown. He will know that that's why you ask for his badge number and get him to initial your log book. Another thing if you refuse to show your logs it is a 34 hour out of service for the driver, not a 10 hr rest break. Then again never asked if the driver was running empty or if he had a load. Empty he could have log off, and finished the drive home under personal truck use.

    Just cause is we are a regulated industry and he was doing a random inspection.

    Actually we are a regulated industry however it is a random search, no different under the law than if a trooper pulled over a car for no other reason than for searching for drugs. Even at the scales they look for something which does not look right thus giving them just cause. Now if it were set up as a spot check they are covered.

    i love the eobr, most of the time they just look at the sticker and say have a nice day ma'am. lol had a level 1 done on donner because a student popped the clutch on their scales. that one was fun. they pull you in and then shut the doors behind and in front of you. your in jail till they let you go. was sweating that one. not because of the logs but because of the trailer. but we had everything in a row and the ducks were free to go. lol
