Keeping my word

    I stated that if Revolutions 1911 posted his case docket number ai would apologize for saying he was full of excrement. He is not on this particular matter he did place himself in a position and found a loo hole to get out of it. He also wasted a fair amount of time and was admonished more than once for going beyond the scope of the hearing.

    But never the less the case exists and the Officer while I believe he was purposely mislead by Mr Hurley, could not legally cite him for log book violations. A ppoint he could have brought up without the quite entertaining but irrelevant rants he presented in the hearing.

    It does bring up a point though that the system did work and he was made whole by dismissal of the citation and forgiveness of the fine.

    I accept your appology and will post later when time permits my reason on why I done in that case what I did. But it was great FUN having the police on the stand for several hours cross examining him. I felt I was extracting payback for all the drivers he put OOS prior illegally. I went through over 1600 reports and did many interviews, this guy was a real trud. I had my fill of him when he started shaking his finger in my face and threw my logbook at me. I bet he still remembers me.

    Tinfoil hat therioes? When the police don't follow the law and rules doing their job thats tinfoil hat theroy? I have proved it more than once in court so call me what you like I WON and didn't pay no tickets, which most of you are so ready to pay without even a question.
    I don't offer legal advice I'm not a lawyer I merely point out you have rights and where you may look for a answer. I also point out you can defend yourself in lots on instances and it's not this big scary boogie man in the court house.

    As to dieselbear he left of his own accord maybe people realize that what he said may not have been that good. Ask yourself ONE BIG QUESTION?
    Why would I seek advice from the police? Thats like asking your enemy how he's going to battle with you. If you want real advice call a judge or lawyer they will tell you the police only know their skewed version of law and it's wrong more than it's right. thats why theres magistrates, courts and judges.
    Ask a good defense lawyer what you should seek or say to the police Nothing or as little as possible. If you have net and a understanding of the law and rules you can read them yourself and use a dictionary or call a lawyer if in doubt.
    But there again I looked at dieselbears thread of the stupid things he seen as a left handed way of saying all truck drivers are stupid.maybe my view is different but I can back it with facts and not plain old assumptions.

    Actually, this is one of the best posts I've seen on this forum and it is spot on...

    LEO's job IS to get a conviction/issue citations...period. They will use everything they can to do so, and this will soon become a mindset in LEO's thinking. This was displayed on many of dieselbear's posts.

    Many LEO's play the fear and intimination card to coerce information out of drivers to be USED agaist them. Drivers don't fall for it. You can be respectful and not help LEO's gather info to be used agaist you.

    Much of what LEO's do is in fact, unconstitional and border line illegal.

    Please explain to me how is unconstitutional or illegal for me to look at your paperwork or your vehicle and verify compliance with the rules and regulations you have to operate under.:biggrin_2558:

    You'll have to enlighten me on this statement. In over a dozen years of driving commercially, I've never experienced this.

    Of course, then again...I don't feel the world is out to get me, either.

    Let me see if I can explain where it becomes uncostutuional or illegal.
    In going on six years I have been "bothered" for various inpsections more times than I can remember. In all of those times my hood has been looked under two or three times and my underneath my trailer once. Now I'm a A class diesel mechanic and have never done a inspection without opening hood or getting underneath vehicle. So do tell how a level one or two inspection can be done then? With a officer writing a 1 or 2 inspection report with above facts, he has just filed a falsified police report a crime in 48 states.
    Thus meaning the officer was operating illegally "under the coulor of law enforcement" and that makes it ilegal and unconstitutional.
    Not to mention the fact that applying the stripping doctrine to the matter would open the officer up to be sued personally. When that kind of thing happens the agency sometimes tosses the officer under the bus so to speak.

    OK, then, I guess you weren't talking about me.

    If I fill out a Level I DOT inspection, I will have been under truck and trailer with a creeper, checked all the lights, tires, brakes, etc. (North American Standard Level I inspection items checked)

    I must be legal and constitutional.:biggrin_255:
