    believe me, I was stunned too. But he said, correctly, what if while he was turning out of the receiver, a car ran under his trailer and was killed? We would be liable for a big lawsuit so a $300 tow bill is a lot better than a million dollar settlement.

    Valid point, even in my days as outlaw trucker sometimes you have to weigh the safety VS what if.

    Disclaimer, I never drove unsafe or endangered anyone but sometimes I wonder about all the ambulance chasers plus the idiots that made them rich.

    I agree, what I do is my business. For now on do all transactions in cash!

    Too many busy bodies sticking their noses in everyone elses stuff. She could have easily looked the other way, ignorance is bliss. My wife works in the safety department of a large Co-op. I didn't know it was her job to investigate what the drivers do on their off times.:biggrin_2559: I'm sure since most of the employees are farmers they MAY be working when they're off the clock but it takes a real Ahole to go looking.

    I wonder how all these nervous nancy's get through life worrying about "if a minivan plows you" crap. "IF" is a huge word. If your Aunt had testicles she'd be your uncle. These people need to stop worrying so much.

    My line is drawn when I park the truck. What I do after that is my business. I MAY have taken my semi and conestoga 30 miles to pick up trees for my house..........what if I didn't log it? Did you hear the *gasp* from all the nervous people in the room? "but but but what if a meteor hit fell and knocked out the power to the traffic lights and a little 'ole lady headed to the nursing home hit you?????" :biggrin_25526:

    Anybody ever ponder the fact that this log checking chick may not understand ANY of the log book work she is doing. She may in fact have log checking software that does everything for her, and she inst smart enough to disseminate gray area from actual dot flag throwing infractions.

    Ok, he was farming, NOT driving a CMV. He states it in his first post.

    Scalemaster, if he was not operating a CMV, then how does it apply to his logs.

    If he was in a tractor, running the planter up and down the field, is he still to log On Duty? I'm confused here. Everyone is saying that he was operating a CMV when he states that he was not.

    You fail to mention how many days you were off work?
    If it was more than seven it would depend on what day you done this so called work? You are only required to give them the last seven days if you were off for more than seven. You fail to mention if you were withheld taxes or a 1099 will be given?
    I would never fool with a co worker after hours for reasons like this or have a facebook page. You know how many people have lost good jobs due to facebook?
    I would be willing to beat this safety lady violates rules somewhere ones that enforce things the worst, are usually the biggest undercover offenders. For all the king ray-ray cheering sqaud reading this?
    If you're in accident and by the slightest chance some billboard lawyer will find out have never been in court?
    You know how many times I've seen a proven liar state "I don't Remember" ?
    Lawsuits are very seldom settled by truth, fact or logic, cases are settled more often by the economic class of the plaintiff.
    The broker they are the higher the award and the underprivliged class is always worth 100 times their true value.

    because the fmcsr states " all compensated work must be logged" someone posted the exact link here. I know most of us do not log it, but still..."murphy"s law". same as working on the dock.

    As a professional commercial motor vehicle operator it is your responsibility to understand that you are responsible for following all hours of service rules and regulations. All work that you are paid for is required to be logged on "on duty, not driving". These hours count towards your 70/8.

    The whole point of the hours of service rules are to ensure drivers are getting enough rest to reduce the number of accidents involving truck driving. If you work through the night, then get in a truck, according to the DOT/FMCSA, you are not a safe driver. You have not gotten enough rest for the work you have performed. This is just like the fact that, as a CMV operator, you are covered by the DUI rules of the DOT rather than the states--meaning, even in your personal car, you can be charged with drunk driving at 0.04 rather than the more common 0.08. This is the life of a truck driver in the modern, highly regulated industry.

    Is it silly? Perhaps. Is it the regulation? Yes. Is it a violation of your privacy and should they stay out of it? Yes. Unfortunately, in America today, the politicians love passing laws that restrict what all Americans do. This does not appear to be changing any time within my lifetime.
