Your all correct, I should have not even responded....but guys...I am SOOOO sick and tired of this guy running his mouth and he is posting the crap ALLLL OVER the place. He just started back up again and it keeps coming to me. He has been booted off transports reviews because he wont stop..... My customers DO see this crap on the internet. I don't need people thinking this company sucks because it don't. We have a 100% rating on Central Dispatch. BUT anyway thanks for your input...Ill stay mute from here out.....

 

Why in the hell did you call your company "Mitten"?

 

Just curious but how do you explain the voicemails. Pretty clear payment was being withheld.

First of all you didnt hear HIS voice mails, and plus the letters already went out to all of the people mentioned above. I was so pissed I was about ready to let him take me to court. I pretty much told him he could kiss my ###. He was such and idiot about the whole thing. His payment was laying here but he would not turn in his paperwork correctly. He was supposed to be here to pick up his orders and his CHECKS but after the one customer called me and was telling me what he was trying to pull with his load, I called him and told to him that he could not take that load. THEN WHEN HIS LETTER GOT HERE.... I was really pissed, and that's when I left the message. I did not have all his paperwork corrected, meaning trip sheets and logs. So I told him he can kiss my ###.
But I felt bad and I did mail his checks to him within that week because after all the crap he said to me my husband would not let him come to the office to pick them up. He sounds soooo nice.....but he wasnt. AND at this point I had had enough of him. I am a real person too, not just an owner, I can only take so much.....

You're just as foolish, if you are going to sue why would you gloat on a public forum? Keep your trap shut and present your case in court.

 

OH this is just bull crap! You actually keep logs from that far back and then KNOWINGLY show falsified logs to a DOT Auditor?

The DOT Auditor cares less about leases and contracts or letters written to you or would even contact other companies about him! All he has to do is enter his CDL number and thats it! He's NOT going to do anything he's not paid to do!

Yes, he'll look at Insurance, IFTA and all the company information, maintenance logs and safety reports and accidents After that all he wants is a BOL to follow a trailer number so they can follow everyone who was hooked to it and follows the paper work from there to look for fuel, drop times, DOT inspections to be sure they are all within limits on that log and but they don't give a hoot in a holler about the lease contracts between company and driver. That's something the Secretary of the State and the labor boards and a few other gooberment offices cover.

Yeah, we believe this crap as NO ONE keeps dangerous logs past the 6 month limit! That's like keeping the gun you killed someone with from 20 years ago! If you had shown him those KNOWING he was falsifying them I'm almost certain your Audit would have gone to a different level! Not to mentiuon a possiable fine for being stupid enough to even show him those pretty colored outside the lines logs!

Your arguing with him is also showing your intelligence level which with me has fallen below the -50 IQ mark especially after listening to that audio of you about the 1099.

As Meltom said you keep this thread at the top every time you reply and from reading some of the posts and your "customers" read this you're cutting your throat. Look at your use of the word "your" which many businesses read posts like yours and think do I really want to do business with someone who does not know the difference between you, your, yours and you're? No I gave up being the spelling police long time ago unless someone just really comes on and looks bad but this is for your (correct usage) benefit as a business. Then they see you doing internet combat with him! I'd go back and delete your posts through the mods and shut the hello up or you'll not have any customers because you're still fighting with the OP and from that audio I pretty much know who I lean towards in believing but I won't fall over for him or you!

At least those from that area when researching Mitten might think before signing anything but for you Miguel I'd pay a lawyer to read it for you.

Miguel, If getting paid on a 7,15,30,60 day or whatever a contract says time period which every contract with a lease or broker has, and you can't live with that, then you really do NOT need to be an O/O or attempt to be one. I'd go drive for a company and sell that truck for scrap so you would get a steady paycheck as you do not understand trucking and brokering well enough.

WHY do you need front money? When you thought you were becoming a "company" spelled O/O did you not have an operating capital account set aside with the down payment for the truck to keep you moving and running like any good company does? This account has enough money in it to pay your usual bills from home payments, food for the family, your operating costs and any MAJOR repair until the statements come in on a regular basics IF you did not turn down loads for some silly reason of I don't go there or I was just there and that list can go on forever with truckers!

Living from paycheck to paycheck as many try to do is senseless and the sure road to failing and winding up exactly where you are!

Mitten. Yeah it sounds like he tried to hold a load hostage and that's where you should have told him to drop it right there and whatever you needed to do like call the police to keep him from helping you lose a customer.

This is one place where you should just sit back and if you get a call from a prospective employer which you'll be sure to get for the next 7.2 years just keep the conservation to a minimum with yes he worked here and no I would not hire him back and that's all you should say to keep him from contacting you back!

NOW, what is the statue of limitations on a civil suit in MI? You both better think on that and get lawyers to handle this as even though it's a civil suit nothing says you can't hire one!

Miguel? I'd just give up slick as you have wasted more time with this thread and posting to it and not having that civil suit filed and served and been there and done it, so just give up as this thread has pretty much killed your chances of winning except for the audio you can use with the IRS because all Mitten had to do to shut you up could have just spent the $.49 and the cost of the 1099 and sent it to you, but being as obstinate as she is she's just dragging that crap out! Such a small cost to shut someone up.

And as I think I posted this in here or another post somewhere in TTR if you do not have a bank account number and the routing information of Mittens bank account you'll never get that money even if you win. The court will not have the information needed to garnish their account And from reading your posts I bet you never made a copy of a single check! The simple rule of COPY COPY COPY is something I doubt you were doing.

Now as a hint Mitten, IF you send him money do it with a Walmart Money order Comm Check or cashiers check from the bank!
