Do i have any legal rights after being attacked and threatenedto be killed by a team

    Yes when he pushed me out of the truck I was hurt but got up and started walking. Someone mentioned why I didn't call any one. The crazy Guy was choking me and my phone was sitting in the cupholder. I walked almost two miles until I saw a truck driver who was parked. I told him what happened and asked if he would please call the truck company the police sheriff troopers and an ambulance which he did. They showed up and saw my injuries and the blood choke marks on my neck etc etc. Photos were taken. The crazy Guy came driving up in the truck while I was being looked at in the ambulance. I don't know what was said but I asked the sheriff if he was going to be arrested because he tried to kill me. They told me no because they were giving him a citation or something and he had to deliver the load. I had been driving when this Guy started talking and acting weird and crazy and he.said something about he was bipolar and crazy which is why I started feeling uneasy too while I was driving. I see where otherhalf said something but yes I have been in touch with sheriffs etc ever since this happened. I am not waiting until now to say or do something about it. I have been doing it but so far have been told I cannot really do anything about this Guy attacking

    I feel sorry for this guys gf or wife if he even has one.You might as well forget seeking legal action against this loser.Just chalk it up as a bad trainer and move on.Even if you did seek legal action,do u have any idea how long it could take?try yrs.

    and who told you, you cant do anything about it? Call a lawyer man. People get away with murder, people get sued over BS, cops get busted doing things they shouldnt.....all done by a good lawyer....get one.

    Instead of coming onto a "trucker forum" and asking advice from truckers.....you should be asking a lawyer for advice....

    Terroristic threats, Assault, Attempted Homicide... yeah I would have been on the phone to 911/State Police after the first unwanted physical contact.

    Edit: so the Sheriff Dep. said he wasn't going to do anything? That is when you politely say, "I'd like you to call your Duty Lieutenant/Shift Supervisor to the scene please, because I am pressing charges."
    Being Bi-Polar isn't a get out of jail free card.. at the very least they would remove him from being in control of an 80,000lb deadly weapon and hold him for observation at the local hospital. Sounds like you were dealing with some backwater yokel police department.

    I'd not only go to the station and file charges but I'd also file a complaint against that officer for not doing his #### job.

    Dial 9-1-1. Only thing you need to call.

    As this was sometime ago, you are still able to make a report and you need to hope you can get in contact with a victims advocate from the district attornies office.

    everybody is saying call a lawyer ~ so what for?....maybe to get a restraining order I guess but how did this person get on your agenda in the first place?....

    So look up the local phone number in the phone book for the regional law enforcement dispatch.

    I don't care HOW they do it. An assault and likely one that could be considered a felony as well occurred and needs to be addressed.
