I forgot to tell you to contact the NC labor board. Which is where you should have probably started.

I've been a driver, O/O, shipper, receiver and dispatcher. It's my experience that the company's side of the story will usually be very different from the drivers. Not many companies are out and out trying to rip drivers off. Most of the time when he was hired the driver agreed to do certain things to terminate properly and didn't do them. Then he whines and complains about how bad the company treated him to anyone that will listen. I'm not saying that this is what happened here, just saying that it's my experience that 90% of the time this is the truth.

That's it . Once a judge issues a decision it's over . There were other routes you could have chosen rather than small claims . You can still report them to the IRS and put an end to their illegal procedures . . If you were a contractor you should have signed a contract .

The bottom line is this, since the company bought the fuel, paid for the tolls, etc, he is not a contract driver, he is a company driver. In NC there is almost nothing that be taken out of a drivers pay, especially tires, oil pans, etc. And the fine for quitting without notice, now that's funny!
As I said the Wage and Hour division of the labor board will have a field day here!
