In california employer must carry WC for employees and when i hired a driver to haul ethanol the 1st quore for WC was about $850 a month which only covered driver on the job and didnt cover me at all. When you bring a driver on board as an LLC he is not an employee but a member of LLC i.e. I made my driver a 1% owner of LLC so instead of paying twice as much for 1/4 of the coverage I had blue cross health insurance for just over 1/2 the cost of WC which covered us 100% after $5k deductible. WC is a total bureaucratic rip-off which is full of fraudulent cases by workers wanting to get paid without working which they pass cost onto all the other companies / suckers even if they never had a claim.
LLC is way to go ....only assets of LLC can be subject to lawsuit as well so if your driver was at fault for an accident that caused more damage than your insurance covers no one can come after your house or savings account etc. Thus" Limited Liability Company" -
2 owner LLC means filing corporate taxes. The whole benefit to llc vs. S corp is that you can file individual taxes instead. Honestly, I'd have a good lawyer before I started making people 1% owners to evade WC. It doesn't sound legal, but I'm not a lawyer.

If I heard "hire a driver", I would take it as an employee.

LLC's are NOT exempt from paying WC, unemployment or any other taxes if one has employees! Always talk to an accountant/ CPA and lawyer before getting into any type of business.

Actually, yes, we do. We don't get gouged out the arse for it, either, and we even have a public health care system covered by taxation, but I'll leave that for the Politics cesspit/subforum.
But unless your laws are radically different from ours, then if you/your buyer hire/s employees, then yes, you/they will have to cover the employees' Workers' Comp., and probably offer some kind of decent benefits as incentive to retain them. Whereas in independent contractor would have to cover that him/herself. Which is it when you say "hire a driver," then, employee or I/C?
One or the other, but not both, legally speaking, unless again, I am very much mistaken (and Cali has gotten even weirder/more corrupt/more dysfunctional than when I was hauling produce out of it, which I didn't think was possible.)
This compels the big question, why are you hawking such an apparently lucrative setup to pretty much just anyone? I should have also highlighted this:
All that for only USD 50,000.00? The truck and trailer alone are surely worth more than that, unless the power unit is beat right to death and ready to fall apart.
Sorry, mate, but my fly-by-nighter radar started screaming the instant I read that. Why would anyone in their right mind unload something like that for that little? Or has trucking in Californicateya become even more low-rent since I was there last?

Why did you copy-paste the OP into a sub-forum geared for new drivers? Barely an hour ago, even? Despite what your CDL mills want them to believe, rookies have no business whatsoever even considering going O/Op without at least a few years of driving and industry experience, knowledge, and ideally, a few contacts under their belts, as I'm sure any real trucker will agree.

Lilbit....LLC's are exempt from paying WC in CA.... I called the Workers Comp office and got it right from the horses mouth before i filed for LLC so you are misinformed. They will tell you you still can have WC if you choose but that is a joke as who would pay the outrageous cost to have WC when it only covers a worker only when he is on the job when owner of company can get health insurance, in my case for both myself and other driver for just over 1/2 WC cost and be covered 24 /7.
Passion4Polishing....As for I'd have a good lawyer before I started making people 1% owners to evade WC. It doesn't sound legal, but I'm not a lawyer ..... it is completely legal and that ius how LLC's work as I filed thru LegalZoom.com whom sent me the complete guide to filing an LLC and anyone you bring aboard you make a member of LLC which his or her duties, obligations and entilements are outlined in the Articles of Organization. ....the 1% ownership that driver / member had was limited to the 1/2 the insurance cost I covered for his policy... the LLC assests at time were valued @ $35K so his share was only $350 which all was also clearly stated in the Articles of Organization. -

Well mate.... I priced the truck just below what other 2006 International 9400i with 600K + mi are going for here in CA and the trailer is also priced around what a 2001 53' van is going for and then the rest is for the turnkey opportunity which allows for someone to start making $ day one instead of jumping thru all the hoops and pulling their hair out when they find out just how much time and paperwork it takes to get to actually booking a load starting from scratch. Are trucks my make , miles and yr selling for alot more in Canada ? I might get more if I take it to North Dakota perhaps with all the oil job seekers but I will try it on here for a few weeks. As for the rest your radar post ... think what ya will ... really doesnt matter .... I grossed $172K last year in 8 months hauling ethanol running 2 shifts with one other driver just 5 of those 8 months so if I dont sell the business I wont lose any sleep over it as I can add a team to the LLC and not have to pay a dime to WC and net more than the $50K I am asking. EH !!!
