    At the initial occurence the blame might be 50/50, was the employee acting in a manner that should have attracted attention and further investigation? Once he was caught on legal perscriptions it is up to the company to follow their own rules in regards to the outcome of the employee's employment. Once the company made the exception to the rule for whatever reason they have now accepted 100% responsibility for this accident. They knowingly allowed an employee to continue to operate machinery even after testing positive for drugs. Even though the drugs may have been legitimate, the employee failed to notify the company of his use of these perscriptions. The company should not have allowed the driver back to work till he had tested clean for the prescription drugs. If you make the rules you either live by them or you die by them.

    Apparently mangement did not see a problem with this presciption and therefore allowed the driver to continue. This was their call and their mistake and now their going to pay for it. Thank god!! no one was hurt.

    Not enough info to make a decision. What kind of drugs, legal or not. What conversation was involved with the company. And guys, no where in that poll question does it say he's a driver. He may not be governed by any laws restricting him and his job. Who's to say the drugs had anything to do with whatever happened. Not enough info.

    Looks like there's a lot of It's not my fault, blame it on everyone else. The person that goofs up, is still responsible and liable. How pathetic, when people think they are not to be held accountable for their actions.

    Script or prescription makes it legal to consume as instructed. Not the question tho.........

    Man was on a prescription,..... as a rule when you are in a safety sensitive job you must report the script to your employer,......... he did not and was caught in a random..........they let him off to continue as usual...........and he had an accident on co. property......... did major damage, 6 digits , destroyed equipment etc.

    Tested again and drug still there. Presence is legal by script. drug was a narcotic.... trips red flag in screen.

    Who's responsible for the accident?????

    " Safety sensitive" ? and he's not....he's an employee. Hard for me to put this one in "stupid" , he rolled a loaded t.w. on the yard, speeding.........that's all you get.....

    Wow, interesting reading.......... tank4life hit the nail on the head in my opinion. Guy was caught in a d.s. unreported........when they ok'ed that behavior then they bought the farm and all that comes with it.

    Fry the decision maker and all others that approved said decision. ( Frying the employee is already a gimme, he's gone IMO )
