Can i legally go off duty for a couple hours to preserve my 70?

    Unless you are performing some function for your job, you are off duty. The boss is the one that gives you a paycheck...... the boss is always right.

    yeah, but hes waiting for the next load to be picked up, not waiting to be loaded. big difference.

    Sounds like he's just in between loads hanging out at the yard.

    you have to stay on duty when loading or unloading 395.1 hours of service, check onduty time. if you get an audit or your company gets one they will match up bill of ladings to logs.

    Where on the bills does it say whether you were inside on the dock, or in your sleeper resting? As long as your check in/out times are close, BOLs don't matter a #### for comparison to logbooks. And that's IF they they stamp in/out times on them. Scale tickets, fuel receipts, toll receipts, etc should match of course.

    As for being on terminal grounds and having to mark it as line 4, that's a load of crap too. If I'm sitting in the lounge watching TV, taking a shower, etc. I'm sure as heck not going to mark that as on-duty. That goes for sleeping in my truck at the terminal too. Sure, fueling, D/H, pretrips, other work stuff like trans-loading or shop work should be marked.

    Now I'm all for feeding the bears as little as possible, but even THEY know there's a point where logging everything EXACTLY as you do it is just plain dumb. There's gray areas we have to work with that will can make your life on the road hard or easy. As long as you don't overdo it, and are staying within the spirit of the law, the smokies won't hammer you for it.

    I have had plenty of BoLs with dates from two days to two weeks prior to when I actually pick up the load... they don't mean squat.

    Same here. Ain't no way to use some of them. Most of my loads are scheduled weeks in advance.

    Many customers don't want you on the dock and unload you. Many drivers hit the sleeper and sleep them 2-4+ hours. SB is SB. I've slept and goofed off on docks more than 10 hours before while you wait for product to come out. Are you saying drivers are in violation when they have no control?

    Do you guys think DOT will look at my logs and think I'm playing games when they see I've gone off duty for three or four hours and then back on duty in a 14 hour period? I can't find anything that says it's not permitted but my boss thinks DOT may give me sh.t about it.
