Leave the truck. There's nothing he can do to you. He authorized you to drive the equipment. You taking a laod and actually delivering the truck to the owner <<< nothing good will come of it.
The situation you are in is nothing new in the trucking industry. If you know you are gonna get screwed, listen to your gut and cut all losses.

Hurst, I'm sorry that your in this position. And I'm sure that its been in the back of your mind for a while after what you've seen. I'm going to reiterate what others have said. Document, Document, Document. Pictures, maybe even a mechanics inspection at your own dime, because we both know what this guy is capable of doing and that he will go to great lengths to discredit the driver. This is a totally CYA situation. And I think that you are well aware of it.

wtf, i just read all that bs you"hurst" wrote on the other thread about how youre not forced to do over weight and all that defending this company and now you sound like all the post that where bashing this guy, which one is it????

I just want to start out by saying I read the other thread first and honestly I have no sympathy for you what so ever. With that being said I am going to give you a little advice from a fleet owners prospective. If it were my truck that you were planning on leaving on the opposite side of the country I would make sure you never got another trucking job again. The funny thing about trucking is you have to be able to prove to a new employer where you spent the last ten years. And I gurantee I would enjoy spending the next ten years telling everyone you applied to what you did with my truck. Now be a man quit crying and take the truck back to Washington.

How can it be abandonment if there's no written agreement as to where the equipment needs to be returned?

Who's crying? Certainly not me. I've spent the last 11 months preparing for this day. My onlyquestio was about the legal side of it. Not the moral or 'Right' thing to do. I know what the right thing to do is.
As for my comments in the other post. I was honest and matter of fact as I could be. If calling someone out on a lie is the wrong thing to do... Well then I guess I'd rather be wrong.
As for someone like you black listing someone like me. Well there are cival laws for that too. Slander, defimation of character, lost wages. Not to mention the last 12 months of documentation I have put together to protect myself from that very thing. The least of my worries is if he gives me a bad reference. His own reputation is enough to discredit anything he says.The Challenger Thanks this. -
If it was me and there was this much drama....... I would call the owner tell him your quitting. You would love to get the truck back to Tacoma with a paid load but before you leave Florida you want your cost sent for a one way coach ticket back to FLOIDA via air. Have him send you a money gram to the truckstop to pa your airfare from Seattle to FL so that you have that prior to returning to Tacoma so your not stranded. If he is keeping your last check that's fine but at least your not stranded if you got your plane ticket in pocket and he gets his truck back and you go home. Tell him you will do the job safely and be reliable and separate with no hostility. If he does not agree to this and is going to keep your check and your not going to be paid to go to FL, I would take his truck to any big carriers yard in FL park it lock it take the keys and leave with office manager and go home and never look back and let the owner know which yard you left the truck at safely and secure. Make sure the truck is clean, fueled, and in good standing. That's the two options. He cant have you arrested don't let him bully you!
