while i agree with you in sentiment, the fact is he killed someone. that guy probably had bills to pay and a family to support, and perhaps even a career that he loved. if the driver faced imprisonment for at LEAST murder 2, as he should, perhaps that wouldve been more likely to throw that into the mix when deciding whether or not he should continue to drive. i say it would be more effective to increase penalties for willful offenders than to create new laws. put the dui/dwi in prison for 1 year 1st offense, 7 years 2nd offense, and life 3rd. fines should be exorbitant for this...5k+ 1st offense. and get rid of vehicular manslaughter for willful offenders...its murder, plain and simple.NavigatorWife Thanks this.

What if a person who has always been considered and deemed healthy, one day, out of the blue, suffers a heart attack or stroke while driving and kills a motorist as he is trying to get the vehicle stopped with poor motor functions. And they come to find out the guy ate a McDonalds #2 meal twice a week for the last 6 months. Does that make him a "murderer"? Not everything related to medical fitness is black and white. Many with diabetes issues are granted waivers and exemptions. Maybe for good reason, by a well-intentioned and qualified doctor, maybe not. And if somehow it is proven that the trucker was personally aware that he was a medical risk to the point of possibly causing a crash, then justice will be served. But otherwise, crap happens, and we are NOT in fact living in a perfect and safe world.
But it will be interesting to read the completed report to see the driver's condition upon stopping and anything he may have said at the scene of the accident and subsequent interviews, and any other eyewitness accounts that may exist.NavigatorWife, volvodriver01 and snowblind Thank this. -

He admitted he had passed out.
They found prescriptions in the truck in his name dated prior to his physical. The prescription was for a medical condition that prohibited his driving a cmv.NavigatorWife Thanks this. -

It sounds like to me the Driver had Epilepsy the same condition that took me off the road in 2000. You have a GTC or a Partial Complex you do not remember What the Hell Happened for the most part for a few Mins. Heck IL let me drive a Car for a Few years afterwards as I was under a Doctors care until I slammed my car into that hotel. Then they revoked my Drivers License until I go before the Medical review Board. Which I can go before at anytime I choose.
