I am a dedicated route driver, out 5 days a week driving about 400 miles a day, with an on duty time of around 9 hrs. My Safety Coordinator called me this week and told me that I needed to switch to using the 70 Hr rule. I had been using the 60 hr rule because I thought I had to use the lesser of the two because there will never be an instance that I drive more than 5 days in a week. When I asked SC to clarify for my exactly why we had to use the 70 hr rule he told me "Thats just how we do it." Which way do I do it??? do i continue or do I switch, and how do you know which one you should follow??

It is based on how many days the company operates, do they operate 7 days a week? If so then you are legally alowed the 70/8 day work rule

Well, I guess that could depend on what you call the company. I work for Worldwide Dedicated Services, which contracts out to many places. My contract facility only operates 6 days a week, Monday thru Saturday. Trucks are dispatched out of the warehouse monday night thru friday night. I only run 5 days a week.

95% of the time we work a 5/6 day week, but still run a 8day/70hr log -

b)(1) Having been on duty 60 hours in any period of 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
If your company does not work 7 days a week, I believe you folow the 60/7 day hour work rule
b)(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.
If they work 7 days a week you follow the 70 hour/8 da work rule.
AND THEN I READ! It's up to the companies discression? So I believe if the company can switch your regulations.?
Guidance: Yes. The only restriction regarding the use of the 70- hour/8-day rule is that the motor carrier must have CMVs operating every day of the week. The 70-hour/8-day rule is a permissive provision in that a motor carrier with vehicles operating every day of the week is not required to use the 70-hour/8-day rules for calculating its drivers' hours of service. The motor carrier may, however, assign some or all of its drivers to operate under the 70-hour/8-day rule if it so chooses. The assignment of individual drivers to the 60-hour/7- day or the 70-hour/8-day time rule is left to the discretion of the motor carrier. -
Should be the amount of days your company operates not the days your contract customers operate...at least that's how I understand it. If you are only running 5 days though it really shouldn't matter, doesn't sound like you are going over on either of them.

Ok, that makes more cents then. I was just disappointed with the answer I was given when it was questioned. Logsrus, Truckin916 thanks for the imput. I know I should never go over the limit of either,(unless there is bad weather all 5 days which require me to be out all 14 hours), thats why i was so confused on why they wanted me to switch to the 70hr after using the 60 hr for all of the 9 months I've been with them.
