Judge finds maverick transportation blacklisted driver,

    For fear of starting a new debate I do have a question.

    If the company (Maverick, or whoever) would have gotten a mobile unit out and fixed the OOS issues, would it have been a valid DAC report at that point? As in, if the driver still refused to return to a yard would the equipment be abandoned at that point since there is no reason to not take it to the yard? Since the driver quit before then I would think abandonment would be valid at that point but would like some insight from some people who is actually in the industry, not just my (currently) outside view.

    According to the wording of the judgment in the case, it is quite possible that it would have been valid. The facts would have been reported correctly. He might have been able to get it overturned by saying he was traumatized by the wreck but that would be a whole different case.

    Years ago the truck I was driving was HI-Jacked. The company accused me of being involved and fired me. But the investigating officers did not. The said company put this on my DAC. (Dumb input Accessments by Companies). I had aOTR job the same day they fired me. So I am not sure what blacklisted means in this case. I wrote a letter to DAC disputing these claims. back to the post"They were at fault for not fixing the problem. The company still has a great case for appeal.
