    Speaking of CARB, it is interesting that the feds use the commerce clause to justify their encroachment into our lives but refuse to enforce it by telling California that CARB doesn't apply to out of state vehicles for any reason.

    That is a good point. Perhaps a carrier that's not based in california could win a legal challenge to a CARB enforcement action.

    Personally I think Cali wants their own little trucking mecca out there and i'm amazed the feds are allowing this to happen.... but there again..money talks. I predict that eventually it will be too costly to enter cali with a run of the mill OTR truck given all these costly add-ons and stipulations and eventually you'll see large drop yards along the state border in Az and Nv (similar to freight forwarders between the US and Mex) and companies will have OTR drivers drop trailers at these yards.. and the companies or power-only carriers will have daycabs ferrying the trailers into and out of cali... just to reduce the overhead of having fleets that can go into Cali. Call me crazy.

    I don't think it's quite that nefarious - after all, they've been setting their own special emissions standards for years where 4 wheelers are concerned.

    But with the CARB rules for autos, it only applies to where they are sold, so there are models and specifications that cannot be sold in California. But if a person buys one while residing in another state, they are allowed to pass thru, visit, etc, into CA. They cannot relocate the vehicle there. They have taken a further step with Class 8 trucks by saying what is legal in the other 49 states may not operate in Commiefornia!
