Presumed Guilty Before Court Trial?

    It goes on CSA either way, inspection or not. As far as telling the company I do not care about a company's policy I would not tell them anything till after court. It is far to common for judges to downgrade tickets to seat-belt or logbook violations. Once your convicted or you plead then it is the company's business. Not before.

    only inspections go on CSA

    Q: Many times an officer may not give a driver an inspection report following a driver inspection; will CSA be able to capture these inspections and use them in the system?
    A: No. If the officer did not complete a roadside inspection report, the inspection will not show up in CSA. Instruct drivers that if the officer did do a complete driver inspection, the driver should ask for an inspection report. However, please be aware that there are several reasons the officer my not have completed a roadside inspection report. Examples include the following:


    • The officer did a simple "traffic stop," not a roadside inspection.
    • The officer was not a MCSAP/CVSA officer. Only officers that have been properly trained can conduct roadside inspections and submit reports.
    • The officer did not do a complete inspection (simply checking a driver's license or log does not count as an inspection; the inspection must meet the North American Standards established by CVSA to be recorded as a roadside inspection).

    That's a lie. When I got a seat belt ticket. I didn't go through any inspection, and those points are now on my CSA.

    I don't believe it. I've seen the process and multiple times drivers have been caught for speeding and it has not landed on our company CSA score, we monitor it closely because my bonus is based off of the performance. Perhaps you were misunderstood as to what you've received, I've had drivers state they had clean inspections only to find out they were place OOS.

    Well let me correct that. He pulled me over because he seen I didn't have my seat belt on. I guess he gave me a level 3

    Driver-Only Inspection


    - A roadside examination of the driver's license, medical certification and waiver, if applicable, driver's record of duty status as required, hours of service, seat belt, vehicle inspection report, and HM requirements, as applicable.

    I've only reported tickets i've been convicted of or that I couldn't get reduced to a non moving violation.

    53, 56, or thereabout is sort of understandable...but 61 in a 45 is just not paying attention...the OP's company knows that too.

    If they forgot to trim the bushes away, he has his proof, right? Easy win for him. In fact, he would have mentioned it. He didnt mention a roadside inspection, because it was probably a local that got him. Had a friend get busted for 48 in a 25 last week. What should I say to him? Had a friend, a really good friend get a DUI in his 4 wheeler. What should I say to him? Another failed a random alcohol. What should I say? I didnt throw the guy under the bus, I asked him if he were speeding. Unless he gets that ticket reduced, he has a reckless. I'm sure you know what that means to his driving career.

    On the other hand, I have friends that have been driving 4 decades without a glitch. Think a million miler gets a million miles by accident, amigo? Perhaps you havent figured out yet that a company will cover it's azs in a heartbeat. You as a driver should be of the same mentality. When someone in your office, or a shipper, or even a cop want you to do something questionable, you cover your own azs first. Thats the rule of the road.

    And your argument will be, "But he hasnt been found guilty yet. Why are they suspending him?"

    Let me tell you something about those little speed trap towns: Most of the people that get tickets in these towns were running 3-5 over. He was running 16! Thats BIG! That says to a safetyman that he was driving blind. You can tell when you are entering into a 1 light town before you see the speed signs IF you are paying attention. He wasn't. Thats a safetyman's nightmare.

    So, what should I say to this particular driver? "Hey man, your company is BS! They should have your back!"?

    I received a ticket on the 11th of this month for,,,,,,62 in a 45. This is my first citation since I obtained my CDL in May of 2008 In fact, it is my first ticket since at least 10 years. I say 10 because I remember getting that speeding ticket, going to court and it getting dropped. I don't remember when the last time I got a speeding ticket that I paid for. Anyway, I digress..... I also had a Level 3 inspection report given to me that stated the reason I was pulled over. So, does that mean I will get the points regardless if the citation gets dropped or not? I have paid $650 to a lawyer to get it dropped or lowered but won't know anything for a month or so. I was BT'ing down Monteagle Mtn going west on I-24 Everyone knows the speed over that Mtn, especially if you live in the area (like me). I have only excuses but hopefully/prayfully, it will get dropped. The LEO told me, "It's in your best interest to show up to court, I don't show up to court".
