So very sad, "what you do today you, will have to sleep with tonight" Arron Tippin. Anger has a way of biting you on the back. If he shows up drinking, make darn sure the cops know! That ain't no toy.
Quick CA legal question if anyone knows...

My question is why u waited so long to do something. U should have jumped ship the minute ur family wasnt being taken care of. F- frienship ur family and home come first. Similar situation I went thru this friend of mine says just hang in there it will pick back up 1 load in a month I was leasing a truck burnt thru my savings at the end of the month I gave the truck back I had already found a job and c ya it didnt matter what he would tell me anymore. Good luck bro.

I would never do this but would be tempted.. 1 gallon of water in the diesel.. Tell him the truck has been running like crap lately.. and let him have the keys.. Don't do that but I would be tempted... Btw it would cost him a lot of money.. 6 injectors and some other major problems..

Calling the labor board is not an option. I assume the OP is a "contractor" and not actually an employee, and somehow I have the feeling there is not even a contract in place. At best there is a contract violation working here but there are no "employer/employee" issues at play here. If there were, we probably wouldn't be having this conversation.

You don't have a legal right to hold the truck without going to court and getting a judgment. Once you have a judgment you can file a lein on his truck. I have always paid employees before paying myself. I understand things can happen, but when you have people who rely on you, it is your responsibility to make sure that your people get paid. If you do anything to damage the truck, you could be liable for any damages. You are in a difficult situation, but hopefully your friend will pay you. You might be able to contact your local state labor board, but I would try to work something out with him without getting the govermment involved.
