    I have told my friends there friends and anyone who will listen for decades " you dont realize how close to dieing you come and how close I come to having a bad day when four-wheelers pull stupid #### on the road"...

    very true,it does depend on the circumstances.But this guy is'nt even fighting it.So unless he does,this will be on his record.I mean when companies look up your record is'nt the fatality also on it or is it failure to yield?

    He does seem all too willing to just accept his lumps...and he mentioned money being tight. Where your career and your ability to continue earning money are concerned, though, sometimes you've just got to suck it up, scrape together what you can, and hire an attorney to fight for you.

    As with anything else in life, actions have consequences. In his case, so will inactions if he fails to do what he needs to do to minimize the damage done to his career. Trusting a company attorney is a bad idea. You aren't the one paying them...they aren't looking out for you. They will only clear your name insofar as it reduces the company's liability. Once the company's liability has been reduced to an "acceptable" level, you're on your own. You NEED to have somebody on YOUR team fighting for YOUR career.

    Amen to that Driver! And they do it every day!
    I can't count the thousands of times my quick reactions have saved lives of stupid drivers.
    "even though i'm not professional according to MittRomknee who has that "Perfect" record"

    Over 30 years and never an accident that i was at fault....i have a few speeding tickets so i guess i'm still a rookie!
    Oh well....he is from California and probably never drove much over 55 mph.
    I can't help i burn up the left lane....and i can do triple digits!....:biggrin_25522:
    Not that i drive that fast anymore but i do like to hook up with some large cars once in awhile!

    "When i looked that way no one was there. This is a known bad intersection with multiple fatalities have happened there." So you knew this was a "bad intersection" but you pulled out anyway? Man, that was a bad decision, an insane decision, by you, and now someone doesn't have a life to live. I hope you never drive again. That way you won't be pulling out in front of me when I'm 80,000lbs and can't stop.

    ...so you'd just sit there parked on the side of the road after making your pickup, too scared to move even though you don't see anyone coming, just because it is a known "bad intersection"?

    I don't buy that for a second. How many times have you been sitting at an intersection where the highway department (in their infinite wisdom) placed road signs right smack dab in your line of sight? Yes, you take the extra time and make the extra effort to try to see around the sign, but you can't get a good look. Eventually, you are pretty sure that nobody is coming...you don't SEE anybody coming, anyway, and so you pull out. Sometimes you were right and the road is clear. Other times, a car might have to apply the brakes. What if the driver of that car that SHOULD have applied the brakes happened to be preoccupied with something else? Yelling at kids in the back seat...texting on the cell phone....changing the radio station....in any event, they failed to hit the brakes and now they've just hit you. Your fault...you pulled out in front of them. Your other option was to sit there all day until somebody moved the sign blocking your view....or in the OP's case, until somebody leveled the hill.

    #### happens. No need to get all sanctimonious over it, because you aren't the perfect driver either. EVERYBODY makes mistakes, and EVERYBODY is going to die someday.

    ...and if you're 80,000 pounds and "can't stop", you shouldn't be on the road either.
