He had a trailer over loaded with tires behind him that would have hit my left steer. I #### sure did not want 50 tires flying all over the interstate in heavy traffic, that is why I went to the shoulder. He kept breaking with me and then came over on the shoulder forcing me to move into the grass I was only doing about 20-30 mph by this point. The last thing I wanted was to cause a major pile up and kill someone just so it would not be my fault. Since when is someone's life less important than " taking the hit". The accident report just shows the details of condition, location, etc. The state police said SC law if there is an accident they have to charge someone. So he gave me "To fast for conditions" and lowered the fine to $80. 3 diff witnesses told them what happened. The pick up keep going and did not stop.

By the way I did not cut the wheel and roll over. I went to the Emergency lane (shoulder) then he came over again on me so I moved to the grass. the angle of the ground caused the freight to shift making the trailer tip over I was doing 20-30 mph at this point. Like I said below I did not want 50 tires flying all over the busy highway causing a major pile up and possible deaths. Lives are more important that " taking the hit" as you say.

Yeas I am sure it did the top ones rolled to the right because of the breaking I was doing and the slope of the ground. Crazy thing was the tractor stayed up right and attached to the trailer that rolled on its side in slow motion. My drive axle was pointing up to the sky and my steer was on the ground like normal. The frame just twisted right behind the sleeper.

Well you should be happy then. You did what was right and it cost you your career. Small price to pay for saving a life right? These witnesses.....obviously you got the names and numbers and plead NOT GUILTY so they can testify. Everything should work out fine.Last edited: Mar 6, 2013

I can't imagine myself allowing a pickup truck to force me onto the grass. I'm not even sure I would let him put me 100% onto a paved shoulder but maybe. I hope your cell phone records don't work against you in court.

That's where you aren't 100% correct. Sorry, but if someone cannot safely merge, I'm not going to risk my life because of their 'mistake'.Tonythetruckerdude Thanks this.

This gnawed at me a bit the other day, so I'm gonna ask. You couldn't outbrake a pickup pulling an overloaded trailer? That should have been easy to do, as he would have been underbraked. And what did he do? Just jam on the brakes, force you off the road, and then go on?
The pieces don't yet make the puzzle whole.
