    was taught a long time ago to always get a piece of the other guy so there is proof that there actually was another guy.

    I had a preventable quite a few yrs back.

    car ran a red light, semi is on my left, people at a cross walk on rt, hit the car broadside.

    they asked the question ;"after you saw him run thru the light what did you do next"

    "well officer I hit him right in the drivers door, going about 35 MPH"

    could have missed him,but would have taken the people at the crosswalk.

    point being , hit the sucker.

    my bad. but I did hit him on purpose as opposed the people.

    Not guilty to what? To fast for conditions, and yea a life is more important than driving a truck! Kiss my ### about the stupid cell phone #### too. Smoke another pack and eat some more pizza and wings you stupid fat ###.

    It's the to fast for conditions ticket that's doing it. Makes it look like it's all your fault just from the wording no matter what really happened.

    Yes he did. You see to tell the full story for you and everyone. I was south bound on I-85 in the rocking chair. A North bound 4 wheeler ran into the median hitting the center guide rail a few times before coming to a stop on top of it. Everyone going South bound of course had to hit there brakes to get a good look. The truck with tires had just passed me when this happened. He then hit his brakes came over into my lane. It was a slight down grade he already was breaking when he came over. I had 78,000 lbs strapped to my ### and went to the shoulder to keep his trailer from hitting me. I did not expect him to continue to brake and come over again. I guess he was getting his cell phone out to call 911 and stop when he should have been paying attention to what he was doing not what someone else had done. The emergency lane if you can call it that is about 3-4' wide not much to work with. Natural reaction was to avoid hitting someone and I would have been OK if it where not for the Super Sacks. There was a tractor trailer on the North bound side broke down that saw the whole thing and came over and talked to the police. Two other witnesses going South with me stopped and told the what happened also. As far as the pick up not being able to slow down as fast as me? How do you come up with that theory. A newer model Chevy 2500 HD pulling a utility trailer slammed full of tires somehow is no match for a Semi at 78,000lbs when it comes to breaking? Anyway if anyone reading this tread has no advice to help me get back in the drivers seat do us all a favor and do not post. Those that do anyway all I have to say is with the DOT regulations getting tighter your days are numbered. Why do you think there is a steady demand for drivers even when the economy sucks.

    Thanks for the full story, it actually makes you look much better than the original telling. But yes, depending on how big a trailer we're talking about, a big truck can easily out stop a pickup pulling a trailer. They don't have enough weight on the front end to take full advantage of the available braking force. A smallish utility trailer, I could see stopping hard; be tough to get enough weight in tires on one of them to be real heavy.

    Then you need the police report of the accident that caused the gawking, the report of your accident, etc.

    And you need to PLEAD your case to anyone you apply to.

    The problem is, without a mark on your truck, there's no proof there 'was' another guy. I was taught in training, if someone's going to hit you, let them hit you. The damage will prove responsibility for the accident. If you cut the wheel, or take the shoulder, or the grass, etc, then it's just you and you alone. And 99% of the 4-wheelers driving by will just keep on driving. They won't stop to give their witness statement to an officer 20 minutes later. They're already in too much of a hurry.

    And as for your remark about not wanting to kill someone at any cost... then your job was worth that. Don't try to have it both ways.

    You screwed up.

    1. You should have let his trailer hit you.
    2. You should have got names, DL#'s addresses and tel numbers of the witnesses.
    3. You should have taken pictures and drawn a diagram of the accident.
    4. You should have plead not guilty.
    5. You should have got a copy of the police report, went to court and plead your case.

    Had you done all those things, you may still have your job. As it stands, because the charge was way back in November, I think you have lost the opportunity to do anything about it. You could still get a copy of the police report and maybe you will be able to contact the witnesses from that....then maybe you can go to your employer and beg for your job back. Until that happens....if it happens, all you have now is your feeling of satisfaction that you did the right thing driver.

    Oh, yeah I almost forgot. I'm 5' - 9", 175 lbs, I don't smoke and #$%& you too.
