Funny seeing you on here! I think that everyone on this blog should get the whole story and the truth. I know that you had trouble telling the difference between truth and fiction when you worked here.
So here is the truth on what happened.
Strike 1: There was lots of work to be had, don't get me wrong- however, I started in mid-December, and I STILL HAVEN'T BEEN PAID.
Peter did not submit ANY of the required for his December pay. Even after several phone calls by payroll to Peter to submit his paperwork. We finally had to submit our payroll without his pay in it. It was explained to Peter about the issue and Peter was told that his December pay would be paid on with his January pay. This would have been deposited on Feb 15th.
By the way Peter your pay cheque was done and you picked it up on February 15.
Strike 2: There was no fall arrest gear provided- after I specifically asked for it, because of the nature of the loads (flat deck work that needed tarping).
Yes Peter did request a fall arrest harness, AFTER he tarped 1 tall load. The rest of the loads that Peter tarped were low loads and did not need the harness. The harness was never given Peter as he quit.
Strike 3: Sending me to the US (no offense to my southern brothers- had a FANTASTIC time down there, thanks to y'all!!!!), and having ME pay for the border crossing on the way down....having ME pay for parts for the truck (for which I was supposed to be reimbursed for, and haven't...yet *crossed fingers*), and having ME do the brokerage for the load on the way back....
Yes, Peter did pay the border crossing fee, BUT Peter was told to submit the receipt and Waylon would reimburse him for anything that he spent on the road that was load or truck related. (Peter never submitted anything, hard to pay on nothing?) Peter NEVER paid for any parts on the truck, all of those expenses were put on Waylons M/C (unless Peter put something on the truck that we dont know about?)
Re: the brokerage for the load, all Peter had to do was fax the paperwork to the broker. Peter was told to submit the receipts for the fax.
Strike 4: During the attempt to get the bill of sale, so I could get US Customs (who were very helpful with this, by the way) to clear the load, as I was walking back to my truck, I was stopped by the border patrol, and searched AT GUN POINT (now, mind you, it is a truck crossing...and pedestrian traffic is suspicious- can't really blame them for doing their job....really, not a huge issue, just the straw that sealed the deal, as it were....)
Funny thing about the border issue? First anyone here or anywhere else had heard about the gun being pulled on you. Funny thing about that is you crossed with some other trucks and they saw you and never mentioned about guns being pulled? Also you ran with a very good friend of our Fleet Manager and the things you were saying about Waylon to that driver were completely untrue. And he was surprised at the stories you were telling him, I also believe that his comment to you was Waylon ALWAYS pays their bills. When I asked you about those comments you back peddled in the office.
Strike 5: Was disciplined at the office when I got back (from what was supposed to be a 10 day rounder that turned into a 17 day rounder), for being late getting to the client (the backhaul that I got stuck at customs for).
Peter you were disciplined about not showing up to work after you got back from the TX rounder. You went home and did show back up to work at agreed upon time. You would not answer your phone and when you did show up a day later, your excuse was that your wife did not want you to go to work because you were gone too long.
Strike 6: Having me pick up a load of pipe (remember, no fall arrest gear?), then having to strap and tarp (no biggie there), and during this- SLIPPING ON THE PIPE- and sliding off the trailer from 13' in the air, narrowly missing a pipe pin on the way down.....landed on my feet (luckily), and crumpled to the ground......got back up, and out of spite, finished tarping and strapping the load properly.
Peter, the load of pipe you loaded? Was that the one that you abandoned in Devon with the windows rolled down, doors unlocked, keys in it, fuel cards(with pins) on the seat? (BTW, Peter never made his delivery and never told anyone he was quiting) Because that load was only 6-7 feet tall from the ground. So how did you fall from 13 in the air??? Maybe you were on top of the sleeper??? Just asking???
Strike 7: After getting back from loading the pipe, parking the truck in the yard, and handing in my keys. .....got a call this morning from the ops manager accusing me of stealing the VHF radio (I'm a ham radio op here in Alberta- WTF do I need a puny VHF radio for when I have dual purpose radios here???), and threatened to take the cost of the radio from my final (sic) pay cheque.......can't be the final one, if I haven't received a single one yet!!!
Your keys were not handed in; you left them in the unlocked truck with windows rolled down. The reason I asked you if you had the VHF radio is it was gone when we got to work the next day and found the truck in Devon with the windows rolled down, doors unlocked, keys in it, fuel cards(with pins) on the seat. The weird thing is Peter told me that it was in the truck when he left it in Devon with the windows rolled down, doors unlocked, keys in it, fuel cards(with pins) on the seat. Peter you said that some one stole it that night after you left it in Devon with the windows rolled down, doors unlocked, keys in it, fuel cards(with pins) on the seat. So if someone stole it that night they knelt on the fuels cards on the seat and stole the radio???
I hope that clears up any questions about Waylon. I thank Peter for allowing me to answer any question he had.
I have been with Waylon Transport for over 7 years and have never had a pay cheque late or not paid to a driver/employee. I find Peter claims unfounded and untrue. Peter you are right about one thing though, THIS WAS A BAD HIRE!!!!

Y'know- I was wondering if you were going to come on here and rebut- thanks for not disappointing me.....however, I was happy to leave your name out (just mentioning your title and the company was sufficient), but you wanna make it personal- hell, I'm game....
I'm not going to get into a p**sing contest with you in the court of public opinion- no one wins in that court. All I can say is you have made some incorrect statements- and I shall leave it at that. However, I see that you're still on about that radio- if you have that much of a problem with it...
I INSIST THAT YOU CONTACT THE DEVON DETACHMENT OF THE RCMP AND MAKE A COMPLAINT.
PLEASE.
If you think that I took it- then do something about it. I am not responsible for the radio, I did not take it, and contrary to what you have accused me of on here, I did not leave the truck in a condition that would facilitate the loss of said radio. So, call the RCMP, and let's put this on record (not just on here). One other thing, I noticed you didn't address the other part of the post- the ILLEGAL deduction of the ticket that the truck got in Garland, and you only briefly touched on the fall arrest gear- incorrectly stating the height of the pipe load I bailed on.......I contacted Canada Labour, and they put onto the Canada Labour Code- would you be interested in what I found? I'm sure every Canadian Trucker out there would be.....oh, and this forms part of (not all of) the basis of the complaint I submitted to Canada Labour.....(drivers up here, take note- you'll want to know this if you work for a company that is non-union, and travels out of province and international)

In the matter of the fall arrest gear:
"Canada Labour Code (R.S.C., 1985, c. L-2): Duties of Employers
124. Every employer shall ensure that the health and safety at work of every person employed by the employer is protected.
125. (1) Without restricting the generality of section 124, every employer shall, in respect of every work place controlled by the employer and, in respect of every work activity carried out by an employee in a work place that is not controlled by the employer, to the extent that the employer controls the activity,
(l) provide every person granted access to the work place by the employer with prescribed safety materials, equipment, devices and clothing."
Now, I requested fall arrest gear- and it was not provided. You admitted here that I had requested it- and that you did not provide it.
In the matter of wages:
"247. Except as otherwise provided by or under this Part, an employer shall
(a) pay to any employee any wages to which the employee is entitled on the regular pay-day of the employee as established by the practice of the employer; and
(b) pay any wages or other amounts to which the employee is entitled under this Part within thirty days from the time when the entitlement to the wages or other amounts arose."
I submitted my payroll for December- and you did not pay me until February. I have the paystub, with the dates posted directly on it, if you need a copy.
In the matter of the illegal deduction of the ticket that the truck received in Garland, TX:
" 254.1 (1) No employer shall make deductions from wages or other amounts due to an employee, except as permitted by or under this section.
Marginal note
ermitted deductions
(2) The permitted deductions are
(a) those required by a federal or provincial Act or regulations made thereunder;
(b) those authorized by a court order or a collective agreement or other document signed by a trade union on behalf of the employee;
(c) amounts authorized in writing by the employee;
(d) overpayments of wages by the employer; and
(e) other amounts prescribed by regulation.
(3) Notwithstanding paragraph (2)(c), no employer shall, pursuant to that paragraph, make a deduction in respect of damage to property, or loss of money or property, if any person other than the employee had access to the property or money in question."
(And these quotes, by the way, are directly from the Canada Labour Code, as printed by the Queen's Printer. FYI.)
So, tell me where I authorized the deduction, complete with the EXACT AMOUNT? Nope, didn't think so. As you can see, as set out in the Canada Labour Code (which applies to Waylon Transport, of which you are the General Manager), you contravened a couple of sections. And the Resolution Officer I spoke to directly at Canada Labour agreed- and yes, I mentioned to her about not completing the last load, leaving it in your yard, etc, etc, ad nauseum. The Officer indicated that it had NOTHING to do with the complaint- and that it would not affect the decision one way or another. The only place that it would affect anything is in the court of public opinion- a place I'm not going to go (well....after this post, that is.....hey- you wanted to go there....)
Now, Blaine, as I said before, I was perfectly content to just mention the name of the company, not you. Why you made this a personal attack, I'm not sure. I can only surmise that you want to save whatever name Waylon Transport may have- and as I stated in a post regarding this matter- and this is a direct quote from my earlier post-
"Gotta clear one thing up- NOT ALL SMALL COMPANIES ARE BAD- not even Waylon.....I'm just relating what happened to me....."
That's my opinion. And frankly, I don't care about you. Insofar as the payroll complaint and the fall arrest complaint are concerned, I'm going to let Canada Labour deal with you.- regarding you and I, the pooh-flinging stops here. And whether or not you find my claims unfounded, well.....all you are, really, is a guy in an office with your own agenda. As am I- the difference is, is that I have a governmental agency that agrees with me. Unfounded? In your eyes, yeah. In the government's eyes- that's the REAL question, now isn't it?

I think he stated that you would have been paid on time but you handed in no paperwork?? Payroll the way it works is If you hand in no Paperwork they can't pay you as it is all done by your load sheet that you fill out. I also work for Waylon Transport I can a test to the Truck being left in the yard with keys in it window's down and fuel cards on the seat as I come in for the early morning Shift and I myself the Fleet Manager for Waylon Transport found the truck and reported it to Our GM right away. I have worked for Waylon for 2.5 years and never had a late paycheck I have always been paid and as far as crossing the Border any repairs that are done Waylon covers all costs ALWAYS Drivers are either reimbursed(If it is something Small) or it has been covered by M/C. We all know about your stories Peter, as you told so many to many of us at Waylon ,Like when you were here the best one was about how you were a trained RCMP officer??? I tell you If I had that kind of training the last thing I would be doing is driving my life away. Oh How about the one about you speaking to my Best friends husband Who I have known for 25 years and all the untrue stories you told him about Waylon You want to talk legally here really we could get our lawyer involved because had that been an owner operator looking to work for us you could have effect our business with your lies and deceit I am sure that My best friend's husband would have no issue testifying in a court of law on that one. To say you were never paid is ridiculous you know you were paid so get over yourself and grow up. Anyway this is only 1 person's opinion and we all have a right to our opinion, but personally I find Waylon a great place to work we have a great bunch on our Fleet now that work hard and are Honest people Waylon is about Honestly and really, here it's like a family away from home. Pay no attention to the man on the moon come check out Waylon for yourself and form your own opinion there is always 2 sides to every story the way one see's it is not always the way it is!! Seriously why is it that when someone gets let go or has a beef with a company or another is it that it is always the others fault. Va6yag your were hired under the assumption that your were what the job required a professional, No don't get me wrong you can steer and gear but there are millions that can do that, you were hired as a professional driver and all that entails. As for your accusations that Waylon in some way shape or form did wrong by you is unsettling as I have first hand experience in how they treated you when it can to repairs and border crossing and such. I know first hand of all the calls that were made mainly after hours and all the help and support you were given when those calls were made. Your Utah experience as you reported it was sadly one sided. I know for a fact that your after hours dispatch made all the arrangements for your rescue and repair as I was the one that received that call and did all the work myself and never once did I expect or ask you to take care of the repairs yourself with your own money. I was the one who paid for all the expense via M/C not you. How about your little incident in TX where a simple and mandatory pre and post trip inspections, that would have shown you that your air supply lines where rubbing through, not realizing it once the lines needed repair and in the process getting a out of service. Hmmm who called dispatch to solve his problem????? Oh wait that was you and who solved that problem getting the lines replaced by a mobile mechanic and paid for the repair via M/C??????? Oh that was me part of the Waylon team who you so graciously have been berating and insulting with your lies. I take this as a personnal attack as Waylon is my family and is the best company I have ever worked for. I agree with Kuchygirl42 come and check out Waylon for yourself and formulate your own opinion, the words of a jaded ex-employee boasting on here to make himself feel better should not affect a sane and intelligent persons ability to see through the lies and B.S. There are three sides to every story....His, mine and the real truth come and find out for yourself and see how far you can go and grow with us. We are always looking for highly qualified drivers and O/O to come aboard and help us.

I'm not going to take any sides in this, just would like to comment on a couple of things which stand out for me. It sounds like the driver "abandonded" the unit in a rather disrespectful conditon, leaving keys in is one thing, but, windows down? In winter? Regardless of how unhappy one is with a job or company, how you conduct yourself upon ending the employment makes a statement about your character. I also wonder how you provide fall arrest protection for a load of pipe? I hauled many loads of pipe back in the 70's and 80's way before safety was the issue it is now, and never fell off a load. Don't you just throw chains or straps across from the ground? And if you do need to get up there, you don't do it until you have at least a couple of chains boomered down, and then you very carefully stay to the center of the load when you are up there whether it's to tarp, or straighten out straps, etc.? Maybe I'm too much old school, and need to get informed about modern practices (lol)? Oh, and I would agree 13' is a pretty high load of pipe! I would say that both parties presented their points well, and without reverting to foul language or cheap shots. It's unfortunate that situations like these do occur, but I guess it's the nature of the business.

This read like a novel, I couldnt stop reading. I have to side with the company on this one. I used to haul pipe for the N.D. Oilfields before it really boomed. I never had fall protection, nor did the shipper have anywhere to hook,up if I did. I just had to be careful where and how I stepped. The way the employees responded and took you to task was impressive, if I lived up there Id check you guys out. You dont find many people who go to bat for thier company and other employees.

Thanks for the great feedback. I am truly blessed with the best employees that a person could get. In regards to this employee it was just a bad hire. He did take us to the labour board. There were a couple mistakes on this employees pay. They were honest mistakes and totaled under $200.00, which we paid instantly. The thing that puzzles me is why this x-employee would slam us so bad and put it on line. Does he not think that his new potential employer would eventually have to come to us for a reference?
