    Drivers sue states after roadside blood sampling results in infection, permanent injury
    For years, truckers have fought random requests for roadside urine tests. As it turns out, the government doesn't want your urine.
    Big brother wants your blood.
    Several state and local governments have enacted laws allowing police to forcibly draw blood from drivers on the side of the road. And in recent months, the issue has hit courtrooms, with motorist Russell Johnson challenging whether several policemen in Washington and Hamilton townships in New Jersey had the right to use excessive force to take his blood at a hospital.
    Johnson claims that officers permanently damaged his wrist in the process.
    In another case, James Green suffered an arm infection after an Arizona policeman repeatedly inserted a needle in his arm to draw blood.
    According to the Wall Street Journal, several states approved laws to allow police to use "reasonable force" to obtain blood samples in DUI cases. Alaska, Arizona, Iowa, Florida, Indiana, Michigan, Nevada and Texas have approved such laws.
    The Journal reported in 2004 that nearly all 50 states operate with the "implied consent" concept - the fundamental belief that by obtaining a driver's license and operating on roadways, all drivers have given the implied OK to search their urine, breath or blood.
    OOIDA has been monitoring the erosion of driver's rights for years.

    WTF???? Take my blood on the side of the highway???? I don't think so!!!!!

    A COP taking blood from me??? No way!!!! Make me go get a blood test, okay... fine... but don't TOUCH me unless you are in an office with gloves on, prove to me the needles are sterile, and prove to me you know what you're doing!!!!!

    That's digusting!! Another abuse of power!!!!!!

    Oh no! That is going WAY TO FAR! I would REFUSE and they could take me to jail for some free meals. No way, that is ridiculous! What are they, Nazi Stormtroopers? Sheesh!

    Without reasonable cause i would never submit to that, even with a licensed paramedic at the scene. We have enough rules to comply with already.

    I know in Dallas they have a mobile blood unit that they will send out. It is equipped like those mobile blood banks that take donated blood. And I have been told that you can not refuse!!!

    It doesn't take training for a driver to whiz in a cup.


    But cops are not trained to draw blood and should not be doing so!!!! As is evidenced by the guy that got infection from repeated stabbings.

    They do this in Germany. If they think you been drinking and driving they draw your blood on the scene. They also might go in and bust about 20 people upside the head with their batoon and cuff about 20 people and end up arresting 2 people. They don't mess around.:biggrin_2556:

    I remember getting a blood test several years ago for insurance, where the TRAINED PHLEBOTOMIST stuck the needle all the way thru my vein into the tendon under it, not once but several times. And they expect a COP to be any better?
    No Freekin Way.

    I am a licensed paramedic. I will not allow any unlicensed persons to even consider touching my arm. This violates alot of medical laws and they can kill a person doing this wrong.......

    I agree... I worked in a hospital in the past as well. If they feel they have to arrest me, so be it... but I'll
    be able to retire on the legal settlement, should they attempt to forcibly take my blood outside of a medical
    setting. And since I don't drink, a 0.0 BAC will help ensure a strong case in my favor.
