Can someone teach me how to make serius bucks???- Out of 5 years at Schneider, most I made was a gross of $43K on the W-2 (their advert. promised "up to $70k")plus $5k to 401k and $0,450.oo HRA; Now haulin sand for a small company that promised the same..... but making less and that's on-call with no set schedule, no days off, paid by the load. I have 1 non-reportable $1,700 and one no-points speeding 9miles over. I now run completely legal and prefer to run same 14hour shift (give or take 1-3 hours) 85% of time. I have 7 year warehouse exp, 7 year airport operations exp., and an AA in accounting. For once in my life i'd like my W-2 to show $70,000 gross, buy a house in an alpine setting , and own a 4x4! Am in Denver area, no wife - no kids; I will be asking lots of questions.....Thank you!!!!!!!!

Funny how these threads start... then change to something else and dissipate.... Anyway, found this article and thought it might be pertinent to this thread.
Here is what it says,
"Truck Drivers work enormous unpaid labor hours but are expected to keep track of federally mandated driving hours to prove that they do not exceed 70 hours. The Fair Labor Standards Act must be addressed as it pertains to truck drivers. This exemption is in conflict with the goal to prevent driver fatigue, highway safety and ethical labor relations."

U.S.Secretary of Transportation: disallow FLSA exemption for trucking upon order requiring EOBR's
The FLSA exemption for trucking, exempting interstate truck drivers from overtime wages is as old as the driver daily records (log book) regulations that have been rewritten in the last few years.
The exemption was a political move to appease big business trucking, as they used the claim that when trucks are out on a trip they cannot track a drivers work and break times to substantiate any kind of hourly pay for non- driving times or track their driving hours in excess of the basic 40 hour work week.
These arguments will become mute with the requirement for electronic on board recorders that will track ALL ON DUTY HOURS, and show the employer ALL work hours.
In as much as the exemption was and is at the discretion of the Secretary of Transportation, we hereby petition the Secretary to withdraw that exemption immediately upon the effective date of any rule mandating the installation and use of on board recording devices and or electronic driver records.

What clown wrote this ? The correct term is the arguments will become moot not mute .

Also only a clown would believe an EOBR would record ALL duty hours . The only accurate hours an EOBR can record are driving hours . Once the truck stops moving the EOBR doesn't know if the driver is on a dock , eating , in the sleeper or anything else .
If wannabes would quit running to bottom feeders to work for 1980's wages until they are starved out and replaced by another wannabe rates might go up and drivers wouldn't have to work 70 hours to survive . Many drivers make a good living working less than 50 hours a week or less .
People are fool enough to accept jobs at substandard wages then say we should all go on strike . Many of us earn good livings with good rates paid by good shippers we have given good service to for years . Why should we jeopardize that relationship by striking to benefit drivers that aren't happy because they got what they asked for ?

Don't forget, truckers/transportation workers are not the only ones exempted. Agriculture workers are also exempted from FLSA. Probably others also. I would agree with the idea that NO ONE should be allowed to exempt their employees from FLSA.
