Didnt deliver melons

I understood from someone who I asked when I was thinking about hauling produce a while ago what he would do if he had a refused delivery and a claim filed against him. He said this is what he has done in the past, put everything in writing of the problems, who he talked to and so on. Calling the shipper, he had the shipper fax the paper work that they were going to file the claim against him and he is responsible for the disposal of the produce, in the mean time he called the insurance company to get an agreement to cover the claim or part of it by selling the load, then called around where he was and found a wholesaler to see if they would take the load off his hands for close to the claim amount, when he found one, he called his insurance company to confirm everything, went to the place that would buy it and sold it on the spot, making them cut a check directly to the insurance company.

Now this may be an abnormal way of doing things but I heard this a couple times when I asked other produce haulers later on.

 

Shouldn't be a problem getting rid of melons tomorrow. Call the original receiver and see if they want them. Maybe there is a local farmer market close by. Or sell them out the back of the trailer. May get lucky and come out ahead.

 

As mentioned make a few calls ( broker, shipper, receiver ) and see if they can help out with the situation. At this point the broker just wants to push the blame around and he is already on to booking loads, etc...The shipper and / or receiver should at least be able to point you in the right direction as to what they want done. Try and get this in writing / email if possible. Your insurance company should be able to provide some resources to the problem however if they can't then call a few local produce wholesalers and see if they will purchase them. Take the money and try and offset the loss as much as possible. Insurance should pick up the rest minus your deductible. If you can get $5,000 at the produce wholesaler and come up with $1,000 then you wouldn't have it count against your loss runs.

As far as getting paid you should entitled to atleast 50% or perhaps the per mile rate for the portion completed however the broker will probably want to see everything resolved first before issuing payment. Just my .02 here and best of luck!

 

You can take that as a loss if I remember right

 

the half delivered should be deducted and any monies due for transport to that point should be deducted from the amount left. what you are liable for is the farm cost of the melons. you should be able to sell melons, its not like they spoil overnight or anything. if nothing else ht a shopping center and sell for a buck apiece.

 

Might be helpful to know where you're at. I've had loads refused but the broker always handled finding a new delivery location. If there's a produce market close by, call some of the produce houses and see if they'll buy them.

also, call your insurance company. I can't believe they wouldn't try to help you get rid of them.
