This is where your friend needs a true legal advise not some basic information on what to do a bout this problem I can't believe that the bank or the repo company has the right to steal the trailer from his paid parking area but this would need a lawyer if it was me I would ask the repo company to return all my stuff or face a stolen trailer charge's and trailer rental for as long as they had that trailer in their possession but it is always wise to discuss this with the lawyer first and see if it is possible your friend may end up making money on this deal.OR he may not. technically speaking.
if the repo man can get access to vehicle. he is within his rights to just take it. BUT, if there are things in the way. he's not allowed to touch to get to such vehicle.
if it's in a garage. and the door is open. he can take. if the door is closed. he can't.
i told the repo man on my bike to get a court order. never happened.
if it's attached to a trailer. and he takes that as well. i would think it would be theft.
before i was a truck driver. i was a mechanic. had a expensive tool box from one dealer. with tools from other dealers. when the divorce was finalized. ex wife had the right to have tool box taken away. since both our names were on the loan. but the tools inside were flat out mine. and paid for. dealer took the box. AND my tools. and ended up in jail for theft. he had no right taking the tools. only the box. -

I repo trucks on the side like most people are saying the laws are not the same state to state. In Texas i can repo your truck nomatter whats hooked to it but i have to release the trailer also im not allowed to pull anything out the truck with out a officer......................Id call a lawyer may cost him $250 for him to right a letter to the tow yard and give them 72 hours to release the property or a lawsuit will be filled remember if you win there going to be responsable for court fees maybe even lawyer fees.

Well the poor guy, he is willing to pay for it for now and fight latter, he is telling me he can't lose another day, so he can still pay them and fight latter when he can afford it.

The trailer would be considered a personal item in this situation. Just like the stuff inside the truck. It was morally wrong to take the trailer but he was supposed to. Now the items inside the truck. The owner should have been notified about it, but after a certain period the items can be removed legally.
