Accident during training

    I didnt. She got scared and slammed the breaks. She couldve passed me easily. And she did with the help of the semi.

    So what your saying is you were merging in at 35 and was going to sandwich her but now your saying she could have passed? I'm confused as the story changes every time you reply. You are pretty much screwed however you slice it dude. You have to wait a few years I guess.

    Sorry, if i wasnt clear. I didnt merge. I tried to merge but i did not, thats reason why i held no damage. Even when the officer came he asked if i hit anyone i said no he said i can go but the semi who hit said i failed to yield, which i did have the intent to merge but didnt to be cleared, (idk if this is revelant or not but i have proof that i didnt even break hard, our truck has an Hard Breaking Event thing and it didnt go off. It did worked because my first week i had one because i got scared i thought i was going off road but it was just the road was poorly worked on, like i said i was trained to always go -10 miles the speed limit for roads i do not know, so i had the time to break and not hit anyone) thats when he said oh nvm stay. After that i was in shock and was just quiet from what happened.

    going 10 under the speed limit can already cause some issues, you should always try to stick close to the speed limit except during heavy traffic, weather conditions, curves etc but going 10 less just gives more reason for accidents to happen, you will have every other truck and car behind you trying to get around...

    Some companies allow a few tickets/accidents, you being a trainee might make that different, you can always try Swift. They let their drivers slide with a few and just give them training classes and stuff. Or find a mom and pop local company who might give you a chance to at least get some experience and time past.

    First off the cowboy in the cattle truck should have gotten a ticket - it is something we have here called unable to stop in a clear and assured distance. It means you can't control your vehicle and stop it if needed.

    Second it was her fault, not yours. If she would have judged the distance, slowed down and than got in behind you, everything would have been fine. I would have asked the cop if she was texting or talking on the phone, to put that idea in his mind that she was not paying attention.

    Overall I would fight it, get a lawyer and fight it. As for being sued, I wouldn't worry about that, if it gets tossed, then she has no case against you, you didn't hit her, the other guy did.

    I would also recommend getting a truck defender program when you get back to trucking, I pay $7 a week for US legal services who will fight all my tickets and stuff no matter where I got it and I dont have to appear in court which makes it hard if you get a ticket in Florida and your in California delivering a load. You figure just 1 ticket fought and dropped will pay many times over that $7 a week fee. The program also covers my wife at home too, they will fight a ticket she gets along with my personal vehicles when im driving. They have a pretty high success rate and they also can fight points too which is over 80% success. If they cant get the ticket dropped it at least gets reduced majorly.
