Everyone ive talked to has said it wasnt my fault, he hit her. Only fault i have is that she stopped because she thought we would have collided with each other. Every person said if he was following the handbook rules, he couldve avoided hitting her, what i have with me is that it was construction zone and he was following too close. Told me not to stress about it and wait for accident report. They told me that my company shouldnt have fired and trainer is actually taking a week off to drive to hq and challenge them on why they fired me. English is a second language for me so sometimes i find it hard to explain things in writing. I wasnt very good at writing in school after i came here.

Earlier you said that the cop cited you for "failing to yield the right of way". But if you never merged in front of the 4-wheeler you should've never got that ticket.
In fact you probably should have kept driving, because an over zealous cop who doesn't like truck drive drivers is what hurt you.

Honestly, you really don't explain it clearly at all.

From what I gather, you were about to merge, decided you could not and started coming to a stop yourself before reaching the end of lane you were in. The car slams on the brakes thinking you're just going to merge and gets rear ended. Is that right? You said you hit the brakes so I'm assuming that you decided to come to a full stop before she slammed on the brakes, or at least slow down a lot to let the car and truck go by. You're not very clear about that point.

I guess my two questions are were you coming up to the end of the merge lane without backing down and were you slowing down before she actually slams on the brakes? Were you that close to the end of the merging lane?

If you never merged over I don't know how you could be ticketed for it. You did screw up in the fact that you should of backed off well before and let them go by. The car assuming you're not going to yield is a lot different than you not yielding and that's her own fault there. The truck following too close is his own fault and problem as well. If you went into that lane at all though you really have no defense in this.

also if your truck has a hard braking events on it, it should have a data recorder that should record speed, location, and other information, may be useful
