Well that's what the attorney is PAID to say! What's he going to do release a statement like this, "my client is a professional blackmailer, who endangers the public by harassing heavy trucks and driving recklessly around them while using multiple recording devices and non-hands free cameras while exceeding the speed limit. On the night in question he-may or may not have illegally discharged a firearm on a public highway."
1.) The jury should have been shown the bullet hole in the truck.
2.) if this idiot missed the truck and hit some little girl in a car seat I think the punishment would have been a bit more harsh.
Did this guy really get no jail time? WTF?!?

I wasnt there and not taking sides and yes, life forms lower than many lawyers likely dont exist but whatever happened its kinda hard to believe the shooter started shooting because the driver simply flipped him off.
Not saying ticking time bombs arent out there that would do something like that, just saying the ticking time bomb could have been the driver partaking in vehicular assault which lead to him getting shot at. -
If that had happened, it would have been on the video. Obviously it did not happen.

You trying to say that a truck going after a car on video was just brushed off? That doesn't happen. This guy shot video of trucks for a living. Getting what he said happened on tape would have been a gold mine for him. He'd have spread it over the net within minutes. So where's the tape? There isn't one, cause the guy is lying about the truck coming after him.
Not that this isn't a years old argument that everyone has already gone over at length. -
Was there a videotape that showed what happened? If so thats one thing but I havent seen where there was a tape. With no videotape it doesnt mean Johnston wasnt attempting to run Volpe off the road and there could be many reasons Johnstons actions werent caught on tape.
It seems like you are being very quick to defend Johnston much like Trayvon Martins defenders when you dont know what really happened and two points stick out here, 1. The odds of Volpe shooting up Johnstons truck over nothing are slim, and 2. Unless you just started driving yesterday you know full well there are many bad truck drivers out there with aggressive and dangerous driving habits. -
I am not the driver that got shot at I seen this on another page when I was looking for more info about the case and ran across this not sure if its really the driver or not..... Sorry for the confusion

You have not done any research at all on the kind of man volpe was. I suggest you do so. I have seen his type in action and it nearly led to the very same kind of shooting. None of us were doing anything wrong at the time and if you are a driver I don't see how you could never have seen this kind of situation. I have seen it many times over the years whether I was involved or not.
As for the tape, this guy recorded absolutely everything. That's what he did. That gives me very good reason to believe that he recorded this incident and since it was not shown, it did not support his story.bullhaulerswife and cetanediesel Thank this. -
Here's the deal with Volpe, in case you didn't go to his YouTube channel and see his videos......
The man acted very dangerous around trucks only to make the driver look as if he was doing something wrong. You could see in his videos that he would speed, cut across several lanes of traffic to catch the name on signs in the videos, etc. He had a GPS on his dash that would show how fast he was going and he would, at times accelerate very quickly to catch what he thought was the driver doing something wrong, when in fact he was the actual danger on that road that day.
He used these videos to extort money out of companies that he didn't deserve, and to get drivers either written up or fired. In the videos you could hear the hate in his voice for truckers.
My understanding of the "altercation" that is mentioned here is and exchange of gestures through the windows. As far as I know, neither party stopped until after the shots were fired.
After viewing many of his videos when this man was first broughy to my attention, there is no doubt in my mind that he exaggerated greatly about what took place that day. Because he was really good at it in his videos, so why not in a court of law?
I allerted OOIDA about this case and maybe they can get the transcripts to see if in fact there was a video shown in court. I'll see what I can do for a followup.cetanediesel and kajidono Thank this.
