I think it would be reasonable to give waivers to drivers from states that have legal marijuana use, to exempt them from a thc testing. After all if a prescription is legal in my state then i wouldn't get in trouble for it on a test.
However, i fail to come up with any reasonable argument why we should allow someone with crack, meth, or anything else drive a truck. It would seem reckless in fact to do so.

Well i think it is quite a reasonable position that the federal government has overstepped it's authority, states ought to be able to have some control over themselves without the feds interference.

They make it real easy.. Do drugs.. Don't drive a truck. Period. I don't care if its not any law at all. I don't want to work around drunks or some body that's high.. They never get hurt.. They get me hurt. It's funny how most non DOT companies are also doing the same drug testing .. They are tired of people screwed up. They want a dollars worth of work for a dollars pay. Also if you get hurt at any job and get a post accident drug test and you fail.. Any workers comp, insurance company, and employer will walk away from you totally and leave you out in the cold. So while your smoking that doobie, think of the concequences that you may get. For every action is a reaction

These are two different legal arguments though. First; this industry is governed by the feds, they are the "Authority having Jurisdiction" over interstate commerce, hence trucking.
Second; States can, and do, allow marijuana use/possession. The POTUS has asked the Justice dept not to enforce federal law on states allowing this practice, that's his option, another POTUS may not agree. The Supreme Court has ruled on this, it's up to the feds to regulate drugs in general.
So now, you have the feds running interstate commerce and making drug laws. How can anyone think for a moment that they have no authority on this matter?900,000-tons-of-steel Thanks this. -

This might be changing. The feds just stated last week in a statement to the media they're going to back of interfering with states that passed the medicinal pot laws. They've said this before so we'll have to wait and see. If the fed is truly going to back off and allow state autonomy and Constitutionalism to prevail then there most certainly will be a rewriting of federal law as applies to pot and drug testing as relating to states that legalized it .... eventually.

I promise you that you work around people who are high, some who may be drunk, and you don't even realize it. There are people in all walks of life, including trucking, who work with a buzz the majority of the time. Now, before you accuse me of condoning this, let me say I unequivocally do not want to share the road with stoned individuals anymore than you, of this we agree.
