Talk to a tax professional. Per deim can be bad or an advantage depending on your situation. I do think it is wrong to force a driver to take it, it is mandatory at my company for the first 90 days....then you can opt out.

There are certain instances where per diem is beneficial. For example, cetain retired federal employees who enter trucking as a second career, are subjected to penalties in the form of a $1 reduction in their retirment check for every $2 in earned income over $15,000 per year. So even with the admin fee, choosing per diem as opposed to pure taxable earnings, may be more beneficial, because it shows a lesser amount of taxable income. Point being per diem may work for a few drivers but it shouldn't be mandatory.

Add Western Express to that "forced" list.

I like the argument that extra pay made from being off per diem "builds up your social security account balance", like the government actually puts your money in an account for you lol. Newsflash, they already spent "your" money before you even contributed to your so called "account". The less money those criminals get the better.

The Internal Revenue Service really needs to surprise audit these trucking companies and really find out what in Samhill is genuinely going on with the per diem. Apparently these trucking companies have come up with a LEGAL way to avoid paying thousands to millions of dollars into social security, unemployment compensation funds, workmens compensation funds, 401(K) funds, and other types of retirement or supplementary funds.

SADLY and UNFORTUNATELY, over the road, (OTR), truck drivers are one of the easiest groups of people to take advantage of because they are continuously "out on the road", and are NOT united together or unionized.

I have spoken to managers and executives of trucking companies They have told me that they do NOT want unions in their companies and that they have "specialists" that are well trained to determine the needs of their OTR drivers. There was NOT much to say afterwards.

God bless every American and their families! God bless the U.S.A.!

The loser in the per diem pay system is the IRS. I am for them legally losing every time possible.

However, I am curious about this admin fee everyone keeps talking about. Are they saying that their pay is lowered by .02 for not taking the per diem? Or is it just the difference between a total of .36 no per diem and .34 plus .02 per diem? If it is a .02 reduction I suspect it is an adjustment due to the company's increased tax liability stemming from the employee's preference in how he will be paid. What they are doing is passing their increased cost on to you. If you don't want the per diem that is OK but I doubt that your employer will just eat that deduction as a courtesy. To even give a choice is more than they have to do it seems to me. It would require two methods in payroll instead of one. The smartest pure business decision from their point of view would be to make the employee take it, like it or not or not offer it at all. But I can see offering a choice to make everybody happy.

It would not surprise me if the Internal Revenue Service, (I.R.S.), did away with per diem altogether.

The only downside to this is that a lot of drivers will end up with LESS money in their paychecks because the companies will not make up the differences to avoid paying extra monies into social security, workman's compensation, unemployment compensation, 401(K) plans and various other retirement plans.

The sad thing is these trucking company's that have been listed so far wont say a word about any reduction in base pay when hired, then you get the socking news in orientation. A true per diem should match your base pay. Example: Starting base pay of .32cpm taxable income of .20cpm / none taxable of .12 = .32cpm Now in my case with Southern Refrigerated Transport the recruiter never said one word of any 90 day mandatory per diem with a reduced pay of .03cpm These guy's tried to con me and say oh! you will make up the difference in taxes. Bull Hockey!! In reality I lost .03cpm an average of $75.00 per week.
