    I just posted in another thread about the fellow I'm leased to. It's basically a handshake between partners.there are four owner-ops leased on here 30 or so company trucks.it truly is first in first out.
    he never forgot when it was one truck. Can't say for company driver but for o/o I know for sure that money is not as important as friendship.

    24 hours for 200 miles. yeah.

    but you all forgot about the part he said. late fee wasn't on the load confirmation.

    his load confirmation never mentioned being late. and to wait several months.

    the load was delivered. the load was signed for. the load was paid for. and several months later they want some of that money back.

    a few years back. i went to the toe doctor. was told 60 with insurance. 100 without. i paid the 100. 4 months later i get a phone for 60. i'm like, WTF. they said just send in the insurance and they would bill them. i said, NO, you charged me. i paid you. end of discussion.

    Right, but your contract was with TQL, not the other broker. TQL assumes the risk of short or no payment in exchange for skimming the rate. TQL paid your invoice and settled the contract with you, therefore they shouldn't be coming back to you because they have problems with the other broker. None of that is your concern. Stop payment on the check that you wrote to them.

    Once upon a time, I was a manager at a chemical plant. We shipped and received bulk chemicals on a daily basis. If we didn't get a truck loaded and rolling within 2 hrs of the scheduled appt time, we were charged demurrage of usually $75/hr by the carrier.
    Now on the flip side. There were times when we would have a batch of something sitting in a reactor waiting for a live load out. If the truck was late, we were told that there were DOT rules which prevented us from charging the carried for late arrival. We budgeted reactor time at an average of $1500/hr, and it would cause a log jam in the whole production schedule, i.e., possibly missed ship times the next day, and etc.

    has anyone heard of any DOT rule governing this?

    I have 2 issues with all of this.

    1) If TQL double brokered this, then really, they have no say in any of this, and I'm wondering if the OP can demand payment from the original broker, and leave TQL with nothing. They should not legally get any of the payment, double brokering is illegal.

    and

    2) If you picked up at 8am and the delivery wasn't until 8am the next morning, only 3-4 hours away, then WHY didn't you just deliver it straight away???
    I would have picked up the load and gone straight to the end with it.

    How are you able to survive grossing $550 a day? If it was a mandatory appointment time of 8am the next day, then $550 would not have cut it. $750 to $1000 should have been your minimum to tie your truck up for the day, depending on where you were, what kind of market you were in. If you're content on grossing $550 for one day, a $150 late fee is probably the least of your worries.

    :laughing3::smt044 NO, not at all. The only thing that happened was they mismanaged there trucks and did not have one available at the time you needed one.

    I am sure that a company as large as TQL has a co-broker agreement in place

    Also it is not illegal
