I misspoke to say "Safe Haven". I think my situation was covered by:
http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.aspx?reg=395.1
under Emergency Conditions. I did document everything both on the eLog and with the written repair of the tire. This provision allows up to an additional 2 hours to complete your run. Interestingly it also notes "Adverse driving conditions" which includes "unexpected" traffic. I've never used that provision myself, but if for example a traffic accident snarls traffic then that should qualify.

Death , taxes and learning to cheat on e- logs.....Meltom Thanks this. -
Don't talk to my drivers, I don't have any free time to catch any more people cheating on their logs!

Only log warning violation I ever got was "logging off duty/not driving while in the sleeper" I guess the officer was bored.
Meltom Thanks this. -

I have drivers attempt to use this all the time. It's funny how the unexpected traffic is always around, Chicago, Dallas, Washington DC, Nashville, Atlanta, right around 5 PM.
Adverse conditions makes sense, but so many people think they can just drive directly into a snow storm, or in once case I've seen a hurricane, and claim adverse conditions to explain their violation just to get to a customer that isn't open anyways. -
i'am still fighting it to this day with Washington state patrol. It makes no sense at all. The officer was digging for over an hour trying to find something wrong during a inspection. Right before I left he asked me what I was doing between midnight and 8am, i told him sleeping, he then ask why I was on line 1, I told him I always log line 1 when doing my 10 hour break. He walks back to his desk, and gives me the warning. I looked at him and just laughed.

Go to your company site on the safestat page and look up your violation and see the points he issued to you. -
Realistically, the whole thing is a joke. I know that physically being in the sleeper is what constitutes being in the sleeper, but if you did 10 hours off duty what is the difference. Either way you weren't performing work, or at least recording on your logs that you weren't preforming work. Reasons like this are why I think there should be no difference between off duty and sleeper"Hang - Man" and tsavory Thank this.

Man today I felt like one of those drivers who sit in the tv longe for 6 hours then mess around on the trucking forum for 2 hours. Then get there 2 hr power nap. Been doing some split logging for the last couple of days and guess I didn't set my alarm right so instead of 2 hour break I got a 3 hour break. Drove 2 hours and 45 minutes and shut her down for another 8 hours even though I had 3 hours I could drive. I guess I'm just getting too old. I can't hang with the big dawgs no more. But I did manage to log 818 miles in 13hr 20 minutes yesterday so maybe that's the reason for my fatigue. But I think its Kansas. Kansas has always gave me problems. This road makes the Houston to Elpaso trip a piece of cake. Now I have to sit 3 more hour until my time is up. Guess I'll go into the petro 2 and see what I can find.
Meltom and "Hang - Man" Thank this.
