I would say he was given a second chance and a third and a fourth and a fifth. Yeah he has changed his life but like I said in my reply, sometimes we make decisions in life without thinking of how it will effect our future. So with more and more illegals replacing us that would make it even more important to not screw up and be as perfect as you can be.

Indeed....now the battle begins. I can promise you this, get even a slosh of alcohol on your clothes and you'll be toast. You are auto guilty because of your past. My best advice is to keep your distance from the stuff even as far as not stopping at a store that sells it. ( for like smokes or snacks ) Not that you would but even the suggestion of impropriety ......is guilt in cases like this. I practice this policy every day when in a CMV.

Best of luck to you driver, I have friends that fight the same fight everyday, it is no picnic.

I think most of us are talking about civil court. It's much different providing cause and who is liable. He may not get any jail time but his career would be over. I know of one case where the pintle hook came apart and the driver lost his trailer. He was exiting the interstate and the trailer went ahead and flipped over at the bottom where an intersection was. It burst into flames (he was hauling gasoline) and right at the same time a young girl drove through the flames and was burned up. The civil trial spent most of the time trying to prove the driver was at fault. You can imagine what they investigated as far as the work place. But they went even further and had the manufacture called in to prove that the pintle hook could never come apart and the driver must have not checked it. The manufacture could not say that the pintle hook never has had any mishaps and in the past there have been reported cases where the hook failed. This is just to show that the lawyers seeking a win and money will go to any lengths just to show the driver must have done something or lack of and it all happened because of that. In civil court the burden of proof is a lot easier than a criminal court. O.J. Simpson is proof of that.

So it's great this driver got a shot at driving. But I believe his struggle is just beginning. He'll be proving his innocence forever, if the companies know about the DUI's, if any little thing happens. It's unfair and we all know everyone can change and should have a shot at work. But trucking is a business where blame and cost are always the other guy. Good luck OP and I wish you well. I also know that you know what must be done day in and day out.

What do illegal immigrants have to do with an individual getting a DUI or having one on his record?

Im in Ohio south of Cleveland. Im not saying its going to be an easy road. having 5 kids a mortgage and the usuals i dont have the time to go back to lengthy school and find something more fitting. Knee surgeries have pushed us to the brink. Thank you for all the posts. Its made me look at both sides of things for real. As they say just take it one day at a time.

Thank you to a lot of the posters on this topic who are willing to let someone start over. Our nation was built by folks who went West to start over. With Computers that becomes harder and harder. DAC makes even the smallest of mistakes something that will follow you around in your trucking careers. DAC doesn't have to prove what it says, it just reports the companies view. I rubbed a curb, put a two inch scratch in a piece of vinyl. The scratch buffed out. DAC reports that as ,"Hitting a stationary object."

The man says he had 5 DUI's, 11 years ago. So we can assume he paid fines for his behavior. He also had to do without his license for a time. He also had to pay higher insurance rates. He also had to go through the public humiliation that comes from being arrested. He also has to live with putting his family through hell for his behavior.

At some point, society has been repaid. This man has the same right to earn a living that each and everyone of us have. I personally have done things I am ashamed of as well as things I should have been ashamed of that I am not.

The first drink you take effects your judgement. Use your judgement to avoid taking that first drink.

And a special shout out to market8687 for quoting Chief Dan George in "The Outlaw Josey Wales".
