I just got an excellent lesson about traffic citations that cut thru all the heresay from other drivers and such.
drove into reno, nevada without an IFTA sticker in early jan., '08. I don't drive out of state, so I didnt even know what one was. just east of donner pass, coming down the gentle slope next to the snowy, rustic truckee river into what looked like whoville, an NHP officer educated me in short order of the use, maintenence and cleaning of the government issued international fuel tax permit and aforementioned sticker, which was missing from my stealth silouette. twas the very day that barak and hilly were in town for the dem party primary.
I presented my license, med card, reg. and insurance. the employer was noted on the cite as the owner of the truck in question. the rest is MY address. they had MY number, NOT my employers. I was the one who signed the ticket and an appearance date in late feb., '08.
luckily, I had the dispatch buy a permit for the day and fax it to me at the corporate yard in sparks. so I had that in hand on the way out that same day.
I did as I was told and gave my boss the ticket. He stuck it in a file and blew it off. didnt pay it. Luckily, last week I get a courtesy notice in the mail giving me 10 days to pay or appear. at this point, I didn't even know if it was a misdemeanor or an infraction. called the court clerk--misdemeanor--7 points. yikes. they had flipped a couple of numbers while typing it into the system and the courtesy notice said I had presented no medical card and failed to appear in february.
my boss laughed at me and said I had better take care of it! He was pissed today when I returned from court after missing 2 days of work. I also gave him a stack of reciepts for travel expences that he questioned his responsibility for. what a piece o'work! By pre-calling around with my old hi-school friend-turned public defender , we were able to get it dismissed with my appearance. I drove 1100 miles in my car to do this.
dont let anyone tell you that the company will take care of it, and that it is nothing...ask the officer if it is a misdemeanor or an infraction. most equipment violations are infractions that auto assign to the carrier. misdemeanors are entirely different.
nevada doesn't have a commercial vehicle code per se--- It's wierd there-

How does your company function????
I am obtaining my own authority (converting over from intrastate to interstate) . Everything, everything..well except the BOC 3 but everything else. How could they let you run without of all things, the IFTA???? States want their tax money.
As a driver I can see that you should have checked out the rig for the proper permits and plates; insurance and registrations. But to expect you to go to court over that??? last time I checked, who ever has the authority is responsible for the permits ect, ect...
I am sorry that you had to learn a very important lesson at your expense. You new drivers, Pay Attention! -
theres a combination of slow and just quit already goin on there now, at good ol' work. I'm off today along with 4 days last week,[2 in reno]. lost wages and 400. bucks in expenses make it plenty memorable. sometimes the blow should be softer so I'm not eternally bitter. I coulda got clicked and clanked too. bad company.
2 weeks ago I caught it deleting hours from my check. it dumped a day [coincidentally my longest one] all after having the largest grossing month to date. what a member -
Not sure what you're talking about, but it sounds like crock and that you certainly got jacked around. Can someone tell me what IFTA is?

IFTA or
http://en.wikipedia.org/wiki/International_Fuel_Tax_Agreement
You need to keep track and report your fuel purchases by state and mileage by state. For example, say you purchased 500 gallons of fuel in Arizona, you notate that in your records with the mileage. When you cross the border of California, notate the mileage you traveled in CA. Then you will file a quarterly report and pay the taxes for the fuel you "used" in CA even though you purchased the fuel in Arizona. CA wants its tax revenue on the fuel that you may have payed a cheaper price..in other words , no matter where you purchase the fuel, everyone else wants their "cut" of the tax action. -
Sounds to me like it's time for a change. You might want to think about getting your resume all polished up and looking pretty!
As far as Nevada DOT there is only one word and we can all guess what it is! -
So you're saying that every time you cross a state line, you have to record your mileage? Does the IFTA sticker exempt you from paying the "home" state's share of the tax on the fuel to allow for this redistribution of tax revenue?
-
Go here for and example of IFTA records:
http://tax.idaho.gov/pdf/ifta/IVMR.pdf
You pay the taxes for every state you run based on mileage/fuel purchases.
If I purchase cheaper fuel in Arizona on my way back to California where I am apportioned, I notate and report the California miles so that California, my home state receives its "share" of tax revenue on the fuel. The states' BOE don't care where you have purchased the fuel, but they want their share of the tax revenue based on their tax schedules on fuel.
Peter and Paul get paid and you pay them. It's that simple.

Oregon does not collect Taxes on fuel. It is an exempt state...http://www.boe.ca.gov/pdf/pub50.pdf
Scroll down to page 24 and you'll see. -
Thanks alot Ron!
