My fiance' started with a new company, was with them for a little over a week, laid down his truck due to road conditions. The cop did not cite him and stated the report will show, including the witness he was not at fault. After 6 hours, the company relented as paid for a hotel. They then had another driver pick him up, give him a new truck and new load. Once in his new truck, a sensor went off, truck was under lease and he brought it to Freightliner per his companies instructions. They then refused to provide a ride or hotel, telling him to pay for his own hotel. He explained he just started with them and doesn't have a bankroll yet. After 6 hours of waiting and back and forth, the owner of the company text him, to , "Stop bothering him, clean out your truck and find your own ride home to your own state." I had to drive out of state to pick him up. It's been 10 days, he hasn't received any paycheck for his first 4 loads he did for them. We're extremely frustrated that companies can do this. Everyone we've talked to states it's illegal what they've done, but aren't sure who we should report this to. Can someone please give some sound advice.

I wonder if the owner of your Fiances company, knows that a good number of buisnes owners has been SUED for firing employees via text message.
I'll site a major Australian case, that is commonly cited in the US court system regarding being fired in unconventional means. -
I wonder if he was truly an employee or a lease driver. -
You need to report it you your states Workforce commission... and the state the company is located in.... Just so you know he is probably done as a truck driver... If he laid a truck over it may not be at fault but it will most certainly be preventable.

He has had his CDL for 8 years. No accidents, nothing, clean record until now. He was on an on-ramp getting on the freeway on a loop. He wasn't cited, the witness that pulled over stated he saw him hit a patch of gravel. Due to the loop of the on-ramp, he couldn't correct it, basically jack-knifed and laid it down. DOT wasn't even called out. Regardless, of this, they then put him in a newer freightliner to haul a new load from AZ to OH. So, they obviously weren't concerned about, "being an unsafe driver". Until he requested they pay for his lodging, then they had an issue. They're a small Indian based company. Yes, he was a full time employee, not 1099, nor lease. He's based in California. Multiple people have stated they cannot strand you out state from your home terminal. Thanks for your comments, I'm extremely frustrated.

I hate to say it but i think the company owner did your Fiance' a BIG favor. He doesnt need to work for a Creep like that.

heck I got fired though a letter to the house that I did not get till after I went back to work and worked for a week. I got my pay check and since Indiana it a right to work state the lawyers I talked to said their was nothing that could be done .
But as to this case I would find a good lawyer and go after them one the left him stranded and two they withheld pay 3 not fired for the accident since they put him in a different truck and under a new load. -

What can you do vs what you want to do vs just moving on. That's what you really seem to want to know. To cut to the chase: FIDO (Forget It, Drive ON) is my advice.
It happens. We get hooked up with a bad carrier (company). Crap happens; they crap on us - we move on. We eventually find a place where we get to do what we love, the pay is OK and they don't crap on us when the crap hits the fan. We call that our "home" company.
Based on what you've said; he shouldn't have a problem "trading up" employers. Oh and BTW; don't take the "flamers" and "shamers" and self righteous twits that will post on how bad he did wrecking and what not, seriously or to heart. They don't know. They think they do - but they don't. We all make mistakes - some serious - when we are starting out. Go with a major carrier and lose the twit that hired him. He will have a WORLD of opportunity. No matter what the empty here wagons might say. The Chinese have an ancient saying about that:
"An empty wagon makes the most noise; even on a smooth road."
