So if I'm in a pickup do they have OBDII scanners that they are going to hook up and check? I do have a tuner I can modify the top speed with.

What is your manufacturer's GVWR? If less than 11,749 kg (26,001 lbs) then you're exempt. If you're not exempt then there's links to the legislation and regulation on the page I linked that you will want to familiarise yourself with.
